 2016 Presidential Message - CESA President Lynne Pretorius will be hosting members of the media on Wednesday February 3, at Hyatt Regency in Rosebank. She will use the opportunity to introduce her theme for the year. Member Firms will be accorded an opportunity to listen to the message during the Presidential Branch Visits according to the CESA Calendar.&nbsp; 
 CESA Biennial Economic Capacity Survey (BECS) - Mandated Principals are kindly requested to expedite the completion and return of the BECS questionnaires as a matter of priority (deadline is 5 February 2016). Last year we had very good participation and good output resulting in two media briefings - a useful commercial predictor and good exposure for CESA (your professional association) 
 2016 Annual Declaration - Members are urgently reminded to update this document by 19 February 2016 in order for the firm to be invoiced in March.&nbsp; Failure to do so will result in a penalty for non-compliant firms.&nbsp; Should you need any assistance, please contact Gillian Wands on (011) 463-2022 or <a href="mailto:gillian@cesa.co.za">gillian@cesa.co.za</a>.&nbsp; Many thanks to those firms who have already updated the document. 
 Alignment of the Construction Charter - From queries and comments received by CESA there seems to be a great deal of confusion wrt the Construction Charter (Sector Code) alignment process.&nbsp; The state of play is as follows: 
 &bull; &nbsp;The Construction Charter has not been repealed (despite the Ministerial (Dti) letter to this effect) and is currently in force 
 &bull;&nbsp; The amended Generic Code does not currently apply to the Construction Sector 
 &bull;&nbsp; The CSCC has written to Minister (Dti) urging the non-repeal of the Construction Charter pending the finalization of the alignment negotiations. The CSCC is yet to receive a formal response from the DTI. 
 &bull;&nbsp; Six alignment meetings have been proposed between 10 &amp; 25 Feb 2016 
 &bull;&nbsp; The CESA CEO will be the CESA Representative at these meetings 
 ECSA update on IDoEW (Identification of Engineering Work) - ECSA has reported that the Competitions Commission (CC) has rejected the ECSA application for the approval of the Identification of Engineering Work plus those of the other five BE Councils (see CC letter received by ECSA on 20 Jan 2016, <a href="https://www.ecsa.co.za/engineeringsa/Documents/200116_Legal_Practitioner_DB.pdf">https://www.ecsa.co.za/engineeringsa/Documents/200116_Legal_Practitioner_DB.pdf</a> . 
 &nbsp;Apparently the CC is of the view that the OHS Act (Construction Regulations) are adequate to ensure the safety of the public. ECSA is considering appealing their decision. Meanwhile the CESA CEO is liaising directly with ECSA &amp; the CBE (where he previously held office). Additionally CESA is preparing a press release calling for a review of this decision. 
 Minister calls for prompt payment and Ombudsman - Minister (Human Settlements &amp; Housing) Sisulu said at a human settlements consultative conference that she will call on Minister Pravin Gordhan to pay small contractors within 7 days, as &ldquo;the legislation stipulates that anybody or any company that does business with government should be paid within 30 days,&rdquo;. Sisulu also indicated that her department would establish an ombudsman office to deal with issues of conflicts between the contractors, provinces and municipalities (see <a href="http://www.cesa.co.za/uploads/20160130_-_Sisulu_calls_for_Prompt_Payment_and_Ombudsman.docx">http://www.cesa.co.za/uploads/20160130_-_Sisulu_calls_for_Prompt_Payment_and_Ombudsman.docx</a>) 
 2016 CESA Practice Notes Seminar - This will take place on 18 February 2016 at the Bytes Conference Centre, Midrand. Learn about the 84 x CESA Practice Notes which were consolidated and updated last year. The seminar has been accredited for one ECSA CPD point and accreditation with SACPCMP for five CPD points has been applied for (see http://www.cesa.co.za/node/566). 
 PAIA &amp; PAJA Training Workshop - Procuring Information and Justice - The Workshop, essential to combat irregular procurement in the Consulting engineering sector, is aimed at training consulting engineers and selected Corruption Watch reporters on the interpretation and application of PAIA and PAJA to enable them to request information necessary for the protection of their rights and to provide them with the tools to prevent and combat of corruption in the procurement space.&nbsp;&nbsp; The workshops will combine specialised training by GIZ (German Development Agency) and the practical experiences of Corruption Watch to provide holistic and targeting training for participants. 
 The workshop is restricted to 20 participants (15 x CESA and 5 x CW &amp; GIZ) so please book ASAP. This would benefit any members involved with public sector procurement, as well as CESA as we move towards implementing our MOU with Treasury to assist with compliance monitoring of the Standard for Infrastructure Procurement &amp; Delivery Management (SIPDM) 
 The venue is the CESA Offices, Bryanston, on 25 &amp; 26 February 2016. The subsidised fee is R2&nbsp;000 per delegate days.  CETA allegations - The matter continues regarding the allegations of mismanagement by CETA. As Secretariat for the BEPG, CESA has been coordinating the legal advice and correspondence. It seems that it will be best for this matter and for future matters that it will be best for the BEPG to form a formal Voluntary Association with a Constitution.

Procurement 
 National Treasury - Separation of SCM for &lsquo;infrastructure procurement &amp; delivery management&rsquo;- During November 2015, in support of the separation of the supply chain for infrastructure procurement and delivery management from that for general goods and services: 
 &bull;&nbsp;&nbsp; an instruction was issued in terms of Section 76(4)(c) of the Public Finance Management Act of 1999 (Act 1 of 1999) (PFMA)&nbsp;which requires the implementation of the Standard for Infrastructure Procurement and Delivery Management by all organs of state subject to the PFMA with effect from 1 July 2016. 
 &bull;&nbsp; &nbsp;a Model SCM Policy was issued for Infrastructure Procurement and Delivery Management in terms of section 168 of the Municipal Finance Management Act of 2003 (Act&nbsp;56 of 2003) (MFMA) in support of the MFMA Supply Chain Management Regulation 3(2) as a National Treasury guideline determining standards for municipal supply chain management policies. 
 The implementation of the National Treasury Standard for Infrastructure Procurement and Delivery Management forms an integral part of the&nbsp;Model SCM&nbsp;policy issued in terms of the MFMA. The issuing of the Model SCM policy enables implementation of the National Treasury Standard through the MFMA&nbsp;to take place no later than 1 July 2017.

 National Treasury has entered into a MoU with SAICE to publish a special edition of its magazine for organisations to distribute to their members. National Treasury is providing the content. SAICE is editing it and compiling the publication. National Treasury is paying for the printing. A pdf version will also be made available. The publication should be ready for distribution during February 2016. The publication will be branded as a Civilution publication.
