There is however a possibility that the Portfolio of Evidence collected by SAFCEC and CESA regarding the negative implications of reverting to the Generic Code of Practice on the Sector, may convince the Acting BBBEE Commissioner to allow the correct Charter scores to remain until an aligned Construction Code is agreed. It has been decided to use a Mediation process to speed up the Charter Alignment process. </p> <p><strong><em>ECSA F</em></strong><strong><em>ee Guideline & ID of Work Exemption applications – </em></strong>CESA has drafted a strongly worded letter to ECSA urging it to challenge/ appeal the recent ruling by the Competitions Commission rejecting these applications. </p> <p><strong><em>“We</em></strong><strong><em> are moving”- </em></strong>The Lease at the current CESA OFFICES in Bryanston has expired and the opportunity has been taken to lease new premises in Paulshof, cnr Witkoppen & Umhlanga. We are trying to improve accessibility to our offices as the William Nicol offramp just remains problematic in that respect. The report indicates that the consulting engineering industry will have to adapt to a low growth environment as the outlook for infrastructure spending is hampered by poor economic growth, lower than expected revenue by government, international economic instability and price volatility, and low private sector confidence. Poor payment of contractors and subcontractors continues to plague the industry. The first draft of the regulations was released during May last year and received much comment from the industry. The first draft of the regulations provided for the removal of conditional payment provisions (such as “pay-when-paid” clauses), and the introduction of the requirement of regular payments and adjudication. Although there were certain practical difficulties with the first draft, the intention and purpose behind the first draft is necessary to address the scourge of late payment.
