FONT-FAMILY: Verdana, Arial, Helvetica, sans-serif">Welcome back to what is in essence the first e-news of the year, trust you had a good break and that the year has started off on a good note. Some of the items have been repeated because the computer problems of the last 10 days have prevented receipt by a number of firms. The Directorate is certainly firing on all cylinders trying to tackle the many issues coming our way such as the mass mailing problem which has been dealt with in separate communications to members. <UL> <LI>Let me start with the most difficult and complex issue which, even after being close to the <STRONG>Charter</STRONG>, I find myself rather confused most of the time. I am going to try and give you a sense of the way forward for our Charter .... <BR><BR> <UL> <LI type=square>For the moment, and until further notice, the existing PPPFA Regulations apply as far as procurement is concerned. <LI type=square>Only after Phases 1 and 2 of the DTI Codes are concluded and gazetted in terms of Section 9 of the BEE legislation can the amended PPPFA Regulations come into play which would harmonise all the legislation relating to procurement in so far as Black Economic Empowerment is concerned. <LI type=square>Once the DTI Codes are gazetted, a 12-month transitional period using the formula (Ownership + Control) x 1,92 comes into play. <LI type=square>In the meantime our sector Charter for the construction industry progresses in parallel in terms of Section 12 followed by gazetting in terms of Section 9 of the BBBEE Act, but this can only happen once the DTI codes above have been gazetted. In addition between Section 9 and Section 12 processes, an industry funded fully independent audit of our Charter has to take place. Once this process is complete the Construction charter then has the same status as the DTI codes. However, once our code is gazetted its transitional period comes into play for the first year when the above formula will probably also apply. The trick here is to keep the gap between the DTI process and our process as small as possible. <LI type=square>The good news is that the Minister has responded favourably to our Code and our construction charter group has agreed with her recommendation, that there only be a series of interim targets for employment equity (management) where a 30% target will apply for the first 3 years jumping to 40% for the remaining 4 years). The Minister was not prepared to contemplate a roll-out in respect of the element for procurement. <LI type=square>As you will appreciate our Charter is unlikely to see the light of day until the last quarter of the year - I hope I haven't confused you. </LI></UL><BR> <LI>We have appointed a new <STRONG>Service Provider</STRONG> to assist us with public relations and the media. This is a very important event and as such I have attached a copy of our MOU above which I request you to please read so that you can see what we have agreed and hopefully allow the spirit of the agreement to filter through all our dealings, especially in the regions and with clients. <BR><BR> <LI>On 13 February we commenced with the Qualitative component of our <STRONG>Client and Member Perception Survey to be followed shortly thereafter by the Quantitative Survey</STRONG>. We hope to have the results available by the end of February. <BR><BR> <LI>I have received a few complaints about <STRONG>unprofessional conduct by recruitment agencies</STRONG> who are deliberately seeking to churn the market and therefore increase their returns. This is no surprise, especially in view of the growth in the economy and skills shortage. I am told that in Cape Town a particular agency places a candidate then goes back to that same candidate shortly thereafter with a potentially better job offer - please be aware. I have been given the name of a particular company, but am not at liberty to disclose in this e-news. If you have a problem please let us know who the perpetrator is. <BR><BR> <LI><STRONG>Webster Ndodana our new President met with the media</STRONG> on the 18th January and he certainly has made an impact and has attracted a lot of media attention which is good for our industry. <BR><BR> <LI>I have mentioned a few times in the past about a potential <STRONG>partnership with DPLG</STRONG> in getting our industry to assist municipalities with <STRONG>accelerated service delivery</STRONG>.
