                        back to what is in essence the first e-news of the year, 
                        trust you had a good break and that the year has started 
                        off on a good note. Some of the items have been repeated 
                        because the computer problems of the last 10 days have 
                        prevented receipt by a number of firms. The Directorate 
                        is certainly firing on all cylinders trying to tackle 
                        the many issues coming our way such as the mass mailing 
                        problem which has been dealt with in separate 
                        communications to members. 
                        <UL>
                          <LI>Let me start with the most difficult and complex 
                          issue which, even after being close to the 
                          <STRONG>Charter</STRONG>, I find myself rather 
                          confused most of the time. I am going to try and give 
                          you a sense of the way forward for our Charter .... 
                          <BR><BR>
                          <UL>
                            <LI type=square>For the moment, and until further 
                            notice, the existing PPPFA Regulations apply as far 
                            as procurement is concerned. 
                            <LI type=square>Only after Phases 1 and 2 of the DTI 
                            Codes are concluded and gazetted in terms of Section 
                            9 of the BEE legislation can the amended PPPFA 
                            Regulations come into play which would harmonise all 
                            the legislation relating to procurement in so far as 
                            Black Economic Empowerment is concerned. 
                            <LI type=square>Once the DTI Codes are gazetted, a 
                            12-month transitional period using the formula 
                            (Ownership + Control) x 1,92 comes into play. 
                            <LI type=square>In the meantime our sector Charter 
                            for the construction industry progresses in parallel 
                            in terms of Section 12 followed by gazetting in 
                            terms of Section 9 of the BBBEE Act, but this can 
                            only happen once the DTI codes above have been 
                            gazetted. In addition between Section 9 and Section 
                            12 processes, an industry funded fully independent 
                            audit of our Charter has to take place. Once this 
                            process is complete the Construction charter then 
                            has the same status as the DTI codes. However, once 
                            our code is gazetted its transitional period comes 
                            into play for the first year when the above formula 
                            will probably also apply. The trick here is to keep 
                            the gap between the DTI process and our process as 
                            small as possible. 
                            <LI type=square>The good news is that the Minister 
                            has responded favourably to our Code and our 
                            construction charter group has agreed with her 
                            recommendation, that there only be a series of 
                            interim targets for employment equity (management) 
                            where a 30% target will apply for the first 3 years 
                            jumping to 40% for the remaining 4 years). The 
                            Minister was not prepared to contemplate a roll-out 
                            in respect of the element for procurement. 
                            <LI type=square>As you will appreciate our Charter 
                            is unlikely to see the light of day until the last 
                            quarter of the year - I hope I haven't confused you. 
                            </LI></UL><BR>
                          <LI>We have appointed a new <STRONG>Service 
                          Provider</STRONG> to assist us with public relations

                          As you will see later some rather sad news, Hillary 
                          Hoskins our Marketing Representative has decided to 
                          leave us for greener pastures after some 10 years 
                          sterling service. We wish her well in her new venture 
                          and are now in the process of advertising the post, 
                          which we consider to be a key position. <BR><BR>
                          <LI>Some more good news is that SAIA (Architects), 
                          ASAQS (Quantity Surveyors), SA Black Technical and 
                          Allied Careers Organisation (SABTACO) and ourselves 
                          have signed a <STRONG><A 
                          style="FONT-SIZE: 11px; COLOR: #ffffff; FONT-FAMILY: Verdana, Arial, Helvetica, sans-serif; TEXT-DECORATION: underline" 
                          href="http://www.saace.co.za/eNews/sabtacomemorandum.pdf" 
                          target=_blank>Memorandum of 
                          Understanding</A></STRONG>. This is a very important 
                          event and as such I have attached a copy of our MOU 
                          above which I request you to please read so that you 
                          can see what we have agreed and hopefully allow the 
                          spirit of the agreement to filter through all our 
                          dealings, especially in the regions and with clients. 
                          <BR><BR>
                          <LI>On 13 February we commenced with the Qualitative 
                          component of our <STRONG>Client and Member Perception 
                          Survey to be followed shortly thereafter by the 
                          Quantitative Survey</STRONG>. If you are approached by 
                          Pulse Research Communications please be patient and 
                          give it some time as we need to know what you really 
                          think of us. We hope to have the results available by 
                          the end of February. <BR><BR>
                          <LI>I have received a few complaints about 
                          <STRONG>unprofessional conduct by recruitment 
                          agencies</STRONG> who are deliberately seeking to 
                          churn the market and therefore increase their returns. 
                          This is no surprise, especially in view of the growth 
                          in the economy and skills shortage. I am told that in 
                          Cape Town a particular agency places a candidate then 
                          goes back to that same candidate shortly thereafter 
                          with a potentially better job offer - please be aware. 
                          I have been given the name of a particular company, 
                          but am not at liberty to disclose in this e-news. If 
                          you have a problem please let us know who the 
                          perpetrator is. <BR><BR>
                          <LI><STRONG>Webster Ndodana our new President met with 
                          the media</STRONG> on the 18th January and he 
                          certainly has made an impact and has attracted a lot 
                          of media attention which is good for our industry. 
                          <BR><BR>
                          <LI>I have mentioned a few times in the past about a 
                          potential <STRONG>partnership with DPLG</STRONG> in 
                          getting our industry to assist municipalities with 
                          <STRONG>accelerated service delivery</STRONG>. It is 
                          at a critical stage and hopefully we will be able to 
                          approach you, as our members, with a request for 
                          assistance shortly. <BR><BR>

                            lobbying mechanism which we can use to our

                          <LI>The <STRONG>first DSTV programme</STRONG> to 
                          assist you with your CPD points was broadcast on 
                          <STRONG>1st February 2006 at 20h30</STRONG> - but only

                          SCE). The feedback so far has been very positive. Next

                          be approaching those interested amongst our membership 
                          to be listed on such a list which will be published 
                          internationally. They will also be developing a 
                          mentoring or pupillage system to assist those who 
                          aspire to become listed. A system is designed to 
                          provide training to enable candidates to prepare 
                          themselves for accreditation and listing. There are

                          successful for the IBDS. Firstly the IBDS has now 
                          positioned itself, and its members, as key role 
                          players of a team that will personally advise the 
                          Minister of Trade and Industry on how he can help 
                          South Africans secure parts of a large project in 
                          Saudi Arabia. While Saudi Arabia might not be every 
                          Consulting Engineers' cup of tea in terms of a 
                          potential market, the important issue here is the role 
                          that one of our member firms will be playing in 
                          advising the Minister! </LI></UL>

                        all goes according to plan, this will become standard

                        our industry and our Ministers with a view to gaining 
                        direct access to business opportunities, particularly in 
                        Africa.</P>

                          <LI>The second important event in the last two weeks 
                          was the successful staging of the African Development 
                          Bank Business Opportunities Seminars. The feedback 
                          from both Bank officials and participants has been 
                          very positive so far. For those of you who missed out 
                          the following achievements should be noted:- <BR><BR>

                            <LI type=disc>The Bank sent a very large and senior 
                            delegation that included a Director of the Bank and 
                            the Executive Director for Southern Africa. 
                            <LI type=disc>Presentations on procurement, 
                            financial instruments and business opportunities in 
                            Infrastructure were all well received. 
                            <LI type=disc>About 100 firms attended the two 
                            seminars in Johannesburg and Cape Town. 
                            <LI type=disc>A special feature of the event was the 
                            fact that participants in the Seminar had the 
                            opportunity to meet individually with members of the 
                            AfDB delegation. 
                            <LI type=disc>At an industry level the profile of 
                            IBDS members as high quality service providers to 
                            the Bank received a major boost.<BR><BR>The Seminar 
                            confirmed that the IBDS' objective of establishing a 
                            long term strategic relationship with the Bank is 
                            well paced and will be to the direct benefit of 
                            members of the IBDS. </LI></UL></LI></UL>
