Interestingly FIDIC is also looking at changes in their Constitution to improve on governance. The new FIDIC CEO, Dr Nelson Ogunshakin assumed his role comfortably, having previously been CEO of the Association of Consultancy and Engineering (UK). The retired Executive Director, Enrico Vink will serve in an Advisory capacity till the end of 2018. </p> <p>Further discussions resumed with SAICE and other VA's on the future of the court Case against the DPW and ECSA. It is anticipated that we should get a court date in the next month.</p> <p>I met with the ECSA CEO to discuss concerns about conflict of interest raised by member companies when employees are invited to interviews and past employees who may have left their employ on bad terms serve on the ECSA interview panels.</p> <p>CESA was invited, amongst other related public sector bodies and NGO’s to make a presentation to the Human Rights Commission on whether the human rights of citizens in the Vaal vicinity have been violated as a result of non-functional water and wastewater treatment systems leading to the deterioration of the quality of water in the Vaal River. </p> <p>Various Procurement issues have been shared with CESA and letters of advice and requests for correcting the issues have been relayed to entities such as Eskom and various Municipalities. Members are encouraged to refer details of any such matters to our offices <a href="mailto:wally@cesa.co.za">wally@cesa.co.za</a> so that we can address these on your behalf. </p> <p>Planning for the last Council Meeting for the year on 15 November 2018 has commenced. Mandated Principals of Member Companies have been invited to attend a Constitutional Review Workshop to discuss “Membership Criteria at present and for the foreseeable future” which will be followed by our AGM and a Networking Session. We look forward to as much support as possible.</p> <p class="clear:both"><img src="images/Line.jpg" alt="" width="760" height="4" /></p> <h1><strong><img src="images/CESA_Icon.jpg" alt="" width="64" class="media-object" align="absmiddle" hspace="5" style="clear:both" />Contractual Affairs, Procurement & Membership</strong></h1> <p><strong> <img align="left" height="213" hspace="10" src="images/Wallys_Section.jpg" width="288" />Another CESA objection bears fruit</strong> – Acting on a recent complaint from the CESA Eastern Cape Branch, CESA informed the Central Energy Fund (CEF) that it was nonsensical to call for a fixed price tender when the scope of works (SOW) was missing from the tender documentation. The CEF promptly responded with an undertaking to make the SOW available to all tenderers and upload the SOW on their website.</p> <p><strong>Merits of CESA objection recognised</strong> – In mid-March 2018, members complained to CESA regarding an Eskom tender for PSP services for Multi-Sectorial Large Infrastructure Projects. CESA raised members concerns with Eskom, in particular the sudden cancelling & reissuing of the tender, and the mandatory requirement for tenderers to be QSEs or EMEs for these large & complex projects. After lengthy and extensive correspondence, Eskom responded on 23 Sept 2018, that “CESA’s letter has been shared with executives within the Group Procurement and supply chain management and management has undertaken to ensure all observations made by CESA members captured in the letter are implemented.” </p> <p><strong>JBCC suite of documents revised</strong> - The JBCC committee have revised the JBCC suite of documents - the JBCC Principal Building Agreement Edition 6.2 (2018), JBCC Nominated/Selected Subcontract Agreement Edition 6.2 (2018) and JBCC Minor Works Agreement Edition 5.2 (2018).
