Our congratulations to Refilwe Lesufi who is a CESA Board member.</p> <p><strong>Employment Equity Targets</strong> – It is our understanding that Government’s intention is that companies not meeting the Employment Equity Targets will not be permitted to tender for any Government work at all. In the absence of a formal approach by Government, CESA arranged a meeting with DOEL and industry stakeholders BEPG, SAFCEC etc. where it was agreed that it would not be constructive to use the ‘stretch targets’ taken from the Sector Codes. The sector was given until March 2021 to submit a sector proposal in this regard and it is proposed to use the CC19RRTT for this purpose. <br /> <br /> <strong>CESA highlights the importance of value in the quest for quality and sustainable infrastructure</strong> – In an interview with Infrastructure News regarding World Quality Day (12 November 2020), I outlined the worthwhile work undertaken by CESA in this regard. To read this interesting article, <a href="http://www.cesa.co.za/uploads/Document2.docx">click here</a>.<br /> <br /> <strong>Ruling against set asides - PP Regulations declared invalid by SCA</strong> – A recent sitting of the SCA ruled that the PPFA Regulations are invalid and unconstitutional, however the BEE Commission has since stated that in terms of the BBBEE legislation, tenders can require 51% black ownership. Note that implementation of the SCA finding is being delayed by 12 months to allow the Minister of Finance possibly accelerate the progress on other legislation which may emanate through the Public Procurement Bill, which would be more legally sound in respect of the prescripts and provisions of Section 217 of our Constitution.. <br /> <br /> <strong>Construction Mafia / Site Disruptions</strong> – Members are reminded that CESA is involved in an initiative with SAPS, with SAFCEC & SAICE, to address this issue and that they ‘must’ report incidents as SAPS need the case numbers, which form the basis of their investigations.<br /> <br /> <strong>SANRAL Workshop</strong> - A SANRAL workshop to discuss tender requirements for consultants that undertake work for them was held on 3 Dec 2020. CESA was well represented at this session. The input from various members based on their experiences was shared with SANRAL. The willingness of SANRAL to address the various concerns was welcomed, however, a few of the key areas which may yet remain an area of frustration both for them and for you as professional service providers is their fear of the impact of the consequences that may arise from the Audit Amendment Act should they be found lacking in compliance with the PFMA, even if they do what is considered “the right thing”. Their limited capacity and delays in tender awards and some of the issues in their tenders, such as the excessive provisional sums which had been introduced with the intention of trying to improve on tender budgeting which have now overtaken the actual pricing for the core work required and artificially inflated the real value of the tenders awarded to appointed service providers. We will be continuing to share your experiences with them and they are, within their own constraints, willing to work with us on continuously improving to the benefit of both parties. <br /> <br /> <strong>ECSA Guideline Fees</strong> – I met with ECSA CEO who indicated that the amended Draft Guideline may be considered at ECSA Council meeting on 26 Nov 2020 and if ratified, the Guideline may be promulgated in December 2020/ January 2021. <br /> Sustainability Summit 2020: 2 – 3 December 2020 – CESA was invited to participate in the panel discussion: “What does Smart Infrastructure mean in the context of African cities?”. <a href="http://susweek.gatherhere.online/">Click here</a> for the CESA virtual exhibition stand.</p> <p><strong>CESA year-end ‘shutdown’</strong> – Members are alerted that the CESA Offices will close on 23 December 2020 and re-open on 4 January 2021.</p> <p><img src="images/Line.jpg" alt="" width="760" height="4" /></p> <h1><strong><img src="images/CESA_Icon.jpg" alt="" width="32" class="media-object" align="absmiddle" hspace="5" style="clear:both" />Contractual Affairs, Procurement & Membership</strong></h1> <table cellpadding="0" cellspacing="0" style="width: 100%"> <tr> <td valign="top"><strong> <img align="left" alt="Contractual Affairs" hspace="10" src="images/ContractualAffairs.jpg" width="200" /></strong></td> <td valign="top"> <p><strong>CESA Management Systems</strong> – CESA would like to inform members of the completion of the following mandatory CESA Management System Declarations (MSDs) as follows (based on the FIDIC Management Systems):</p> <ul> <li>Quality Management System (QMS)</li> <li>FIDIC Integrity Management System (FIMS)</li> <li>Project Sustainability Management System (PSMS)</li> </ul> </td> </tr> </table> <p>Member firms will be required to complete the online MSDs annually and submit them to CESA, as the basis for the evaluation of the level of development of their management systems. CESA will conduct verification reviews on randomly selected member firms in order to confirm the contents of the completed MSDs.<br /> A procedure has been drafted to explain these management systems, which will be introduced at the end of 2020 with the distribution of the Annual Declarations to member firm</p> <p><strong>Feedback on Draft Public Procurement Bill (PPB)</strong> – As reported previously, National Treasury held a webinar on 21 October 2020 outlining progress on the development of the PPB, including a rough timeline for its implementation, that indicated that the Bill could be passed into law in November 2022.
