We find ourselves in a predicament as we are in the middle of an audit based on the amended generic codes, as our financial year end was on 28 February 2017. We had prepared for the audit in line with the new generic codes in the absence of the new Construction Sector Codes which we had hoped would be promulgated by the end of February 2017. Since the closing date for comment was December 2016. In light of this, would you agree that we base our audit on the amended generic codes despite the fact that new construction codes might be gazetted in the next month?</p> <p><strong>Answer (Directly from the Construction Sector Charter Council)<br /> </strong>1. All construction sector measured entities in your circumstances and conditions - to the extent that the new sector code is yet to be gazetted - are expected to finalize their measurement in accordance with the Generic Codes of Good Practice. </p> <p>2. The process of submitting the final sector code for gazette by the DTI is at a very advanced stage (about 98% complete), with the write up to be sent to the DTI this week.</p> <p>3. We have however included, as part of the provisions of the new construction sector code, notably section 10 that deals with the Effective Date & Transitional Arrangements, a provision to the effect that: </p> <p>"10.3 When the Revised Construction Sector Codes are published, measured Entities may elect to re-do the audit carried out for their current valid scorecard that was done under the provisions of Revised Generic Codes of Good Practice, under the provisions and principles of the Revised Construction Sector Codes. This audit will be done for the same financial period as their current scorecard, but under the measurement principles of the Revised Construction Sector Codes."</p> <p><strong>United action by the Engineering Industry</strong></p> <p> In the last CE-track, we mentioned that SAICE was taking ECSA to Court, as the papers were signed by SAICE, however, the action was carried out and mandated on behalf of 14 other industry organisations including CESA.
