There is no doubt that our Member Firms will be impacted by this situation, and that it is certainly not going to be “business as usual” over the coming months. CESA deliberately delayed communicating with our Members, until there was more clarity on the numerous impacts that the lockdown is going to have. We convened an Emergency Board Meeting on Friday, 27 March 2020, at which the Board reconfirmed that CESA must continue to provide as much assistance to members as possible during these trying and uncertain times. </p> <p>To this end, you will be receiving several communiques over the coming weeks with various elements of information which may be helpful as we all navigate our way through this difficult time. We are in the process of gathering more detail that will be shared with you on all the issues at hand, such as, but not limited to and in no specific order:</p> </td> </tr> </table> <ol class="auto-style2"> <li>Clients’ approach to managing the situation, and the impact that it will have on Project Delivery, and in particular, on Member Firms;</li> <li>The Solidarity Fund mentioned by the President; CESA’s contribution to the Fund; Individual Members contribution to the fund; and how Members in distress access the Fund;</li> <li>SMME Assistance initiatives linked to Point b or any other sources of assistance;</li> <li>The UIF process as a source of support for employees and Members in distress;</li> <li>Information on managing Business Continuity, Business Risk, Financial Capacity, etc. </li> <li>Membership specific issues such as subscriptions, events, non-payment by Clients and any other queries;</li> <li>HR & Remuneration insights related to the current crisis situation (which due to the sensitivity, will be limited to the Mandated Principals of each company) </li> <li>Any other relevant urgent information,</li> </ol> <p>We will disseminate this information through a series of communiques over the next few weeks. Please look out for these and should you have any further queries do not hesitate to contact us at <a href="mailto:general@cesa.co.za">general@cesa.co.za</a> or on our CESA mobile office number 078 740 2795 as our offices are closed.</p> <p><strong>Moody’s downgrade of SA’s Sovereign Debt</strong> - We have taken note of the decision by Moody’s to downgrade SA’s Sovereign Debt rating to junk status and whilst the impact of this downgrade will only be felt in the weeks to come, CESA will continue to engage with the relevant decision makers to try to fully understand the impact that this will have on the investment in infrastructure delivery and subsequently on the industry.</p> <p><strong>BUSA Statement on Moody’s Downgrading SA To ‘Ba 1’ (Junk Status)</strong> - Business Unity SA (BUSA) notes with dismay the decision by Moody’s Investors Service to downgrade SA to “junk status”. It is an indictment on our country that BUSA needs to say this is not unexpected! Moody’s was the last of the major rating agencies to rate SA above junk status and had been indicating for some time their concerns about our lack of economic growth, bloated public expenditure, state of our SOE’s, our inability to make necessary structural changes in the economy and our labour market structure. <a href="http://www.cesa.co.za/uploads/BUSA_Release_on_MOODYS.pdf"> Continue Reading</a></p> <p><strong>DPWI notice re temporary suspension of construction sites</strong> – DPWI has indicated that it will grant extension of practical completion without cost to contractors on its projects in terms of both JBCC and GCC contracts, <a href="http://www.cesa.co.za/uploads/Notice_to_all_contractors_and_PAs_covid_19_25_March_2020.pdf"> read here</a>.</p> <p><strong>National Treasury instruction to accounting authorities</strong> – Treasury has requested the accounting authorities of all government organisations/state entities to observe the extension of procurement dates as follows: </p> <ul> <li>Submission of Procurement Plans extended from 31 March to 31 May 2020.</li> <li>Tenders closing during or 14 days after Lockdown to be extended by 21 days after Lockdown ends.</li> <li>Tender validity periods to be extended to allow state entities time to evaluate tenders.</li> <li>State entities to refrain from issuing new tenders during Lockdown.<br /> <a href="http://www.cesa.co.za/uploads/Correspondence_on_procurement_dates_due_to_National_Lockdown.pdf"> Read here</a>. </li> </ul> <p><strong>Construction Sector meeting with National Police Commissioner & the NPA on 20 March 2020</strong> – CESA attended the meeting together with SAFCEC & SAICE to discuss the criminal invasion of construction sites by ‘business forums’ and local communities (often referred to as the “Construction Mafia”). It was agreed inter alia that:</p> <ul> <li>The National Commissioner, NPA and Construction Industry will continue to meet quarterly in this regard.</li> <li>The meeting will be run on a partnership basis, under an MOU </li> <li>A task team will meet and establish the terms of reference of the above meeting</li> <li>The police will commence with profiling of repeat offenders in construction mafia </li> <li>New stricter bail conditions will be established and enforced</li> </ul> <p style="clear:both"><img src="images/Line.jpg" alt="" width="760" height="4" /></p> <h1><strong><img src="images/CESA_Icon.jpg" alt="" width="32" class="media-object" align="absmiddle" hspace="5" style="clear:both" />Contractual Affairs, Procurement & Membership</strong></h1> <p><strong> <img align="left" alt="Contractual Affairs" hspace="10" src="images/Bookstore.jpg" width="200" />Council for the Built Environment (CBE): IDOW meeting on 3 March 2020</strong> – CESA attended the CBE ‘Identification of Work Steering Committee (ISC)’ meeting as a representative of the Built Environment Professions Grouping (BEPG) and can positively report that:</p> <ul> <li>The CBE has met with the Competitions Commission (CC), which misinterpreted the recent publication of IDOW & Fees by the BE Councils as duplicating the original exemption application (in 2015) whereas the newly published Fees & IDOW actually address the problems raised by the CC at that stage (2015).</li> <li>The CC requested the CBE to withdraw its published Fees to which the CBE replied that the publication of fees was linked to its statutes. To satisfy the CC, the CBE’s will explain on its website the relationship between the statutory requirements and the published Fees.</li> <li>The CBE will respond to the CC re the Fees after the next CBE council meeting.</li> <li>The ISC is currently drafting an IDOW policy framework for approval by the CBE, which will hopefully be finalised before the end of the year. Unfortunately, an ISC workshop to develop and finalise the draft policy framework has been postponed due to the current COVID-19 Lockdown</li> </ul> <p><strong>BEPG meeting held on 10</strong> <strong>March 2020</strong> – CESA is currently the Secretariat of this Grouping. The following matters that may interest members were discussed:</p> <ul> <li>The issue of unlimited liability was raised in order to determine a common view on the subject as requested by the DPWI. The consensus was that liability should be limited to a suggested twice the fees paid to the Professional Service Provider (PSP). It was further suggested that the DPWI DDG (Construction Mgmt) should be invited to a BEPG meeting where the topic could be discussed.</li> <li>In discussing the New Procurement Bill (NPB), which was disseminated recently to CESA members for comment direct to National treasury, it was suggested that the BEPG submit its consolidated comment on the NPB via the CBE’s Transformation Forum (in this way the comment will be viewed as from government to government).</li> <li>It was mentioned that the ASAQS was coordinating a survey of late payments to consultants and contractors in the construction sector and had requested the participation of BEPG members and other VAs in disseminating the survey to their members. CESA has disseminated the survey to members and requested their participation</li> </ul> <p><strong>Performance Guarantees</strong> – CESA is currently engaging JW (Johannesburg Water) in order to have the Utility drop its tender requirement calling for the provision of Performance Guarantees by consulting engineers. Apparently, a number of public sector bodies such as Midvaal LM, are including this requirement in their tenders. Any member firm encountering this problematic approach, which is clearly intended for contractors and not consulting engineers, is encouraged to report their experience to CESA (Wally Mayne at 082 929 2790 or <a href="mailto:wally@cesa.co.za">wally@cesa.co.za</a>) so that we can gauge the extent of the problem and engage with National Treasury if warranted.</p> <p><strong>CESA’s Contractual Affairs Help-Desk</strong> – Members are reminded that CESA will wherever possible assist them with advice pertaining to procurement issues, roles and responsibilities, the ECSA Fee Guidelines & Scope of Services, contract documentation, PI issues etc, simply phone/drop Wally Mayne an email at 082 929 2790 or <a href="mailto:wally@cesa.co.za">wally@cesa.co.za</a>.
