	to pay court costs – The Westwood Judgment sets a damning precedent 
	for officials that tinker with the law and opens the way for cost orders to 
	be issued against officials in the municipality. It is a principled 
	judgement that may now cause anxiety amongst certain SCM Committee members 
	(BSC, BEC and BAC) across the public sector after learning of this case, see

	Working at risk – We have received a number of 
	complaints from member firms, who have undertaken preliminary design work 
	for Clients who have then proceeded to appoint other consulting engineering 
	firms for the next phase of the project without paying the original member 
	firm for their initial work.

	been developed over many years to protect member firms from, inter alia,

	Amendment of EPA, Guideline Fees &amp; Identity of Work – 
	The following position statement appears on the ECSA website and has been 
	confirmed with them as follows: 
	The Engineering Profession Act 46 of 2000 (EPA) is in the process of being 
	amended and this is only going to be finalised in 2019. Stakeholders will be 
	able to comment on the amendments during the public consultation stage.
	<ul>
		<li>The guideline for professional fees 2017 is held in abeyance until 
		the legislation has been amended </li>
		<li>ECSA has appointed independent lawyers to formulate the grounds of 
		appeal to the Competitions Commission (CC) ruling – these are not yet 
		finalised. ECSA confirmed that the appeal will also be held in abeyance 
		until the legislation has been amended.</li>

	SIPDM Training Seminars – Since the last edition of 
	CE-news, three more Seminars have been successfully held in Port Elizabeth, 
	Bloemfontein and Mbombela. The SIPDM training course is accredited with two 
	ECSA CPD points and the next training seminars are scheduled for: 
	25, 26 July 2017 – Polokwane 
	10, 11 Aug 2017 – Rustenburg (new dates) 
	22, 23 Aug 2017 – Gauteng 
	11, 12 Sept 2017 – Durban (new dates) 
	19, 20 Sept 2017 – Cape Town

	A new round of exams is in the process of being arranged in conjunction with 
	the CESA Branch Chairmen for July/August 2017 for the delegates (who 
	attended the first eight training seminars held this year). The cost of the

	The New Public Sector Rules for Procurement in Construction Sector 
	– A very successful Breakfast Seminar was held on the 5 July 2017, in 
	Midrand at which Dr Ron Watermeyer, a CESA member, explained the principles 
	and requirements of both the SIPDM and the New PPPFA Regulations. The 
	possibility of hosting this seminar' in other CESA regions is currently 
	being considered.

	SACPCMP Presidential Forum Meeting – The Presidential 
	Forum, constituted by both Private and Public sector stakeholders aims to be 
	the voice of the profession and the industry to promote the designated 
	professions and specified categories. It will further contribute to relevant 
	industry policy development and create opportunities to educate public 
	sector clients, in particular, about the use of these valued professions to 
	protect public interest.
	CoGTA Bi-Annual Partnership Meeting – on 23 June 2017, 
	CESA attended the Bi-Annual Partnership Meeting. The department presented 
	the next Phase of 'Back to Basics', following the 3rd Presidential Local 
	Government Summit (previous 'Business Adopt a Municipality' programme).
