Pillay's 2020 theme is '2020 - A time for Reflection, Renewal and Regeneration'. Pillay began his presentation by stating, "South Africa once again finds itself in the throes of a new era, and we are certainly in a period of great change but there is also a sense that through this process, that we are indeed in a period of renewal and regeneration." To access his speech and presentation please visit: <a href="https://www.cesa.co.za/node/727"> https://www.cesa.co.za/node/727</a><br /> <br /> <strong>ECSA Fee Guideline</strong> - At the invitation of ECSA, CESA has nominated a number of our active participants (from member firms) to serve on the ECSA Fees Guideline Task Team. As previously reported the Council for the Built Environment (CBE) has requested its six Statutory Councils (including CESA) to update and publish fee guidelines for their constituents. The Council for the Project Managers (SACPCMP) has published its Fee Guideline & IDOW, while the Councils for the Architects (SACAP) and the Quantity Surveyors (ASAQS) are in the final stages of approving and publishing their Fee Guidelines & IDOW.</p> </td> </tr> </table> <p><strong>Flying the CESA Flag</strong> - It has been a busy start to 2020 and I have attended a number of high-profile meetings in January to raise the profile and relevance of CESA as well as to advance the interests of the consulting engineering sector. The meetings included the following:</p> <ul> <li><strong>Business Unity South Africa (BUSA) Economic Indaba</strong> - to which member firms were invited and several were able to attend. The President, Cyril Ramaphosa was the keynote speaker and pleasingly confirmed the sentiments of our industry wrt the need for action and implementation.</li> <li><strong>National Planning Commission</strong> - I attended a workshop on Infrastructure Delivery held at the Union Buildings and I'm happy to share that the NPC is looking at how best to fast-track planned infrastructure projects</li> <li><strong>Infrastructure Investment Office (IIO) in the Presidency</strong> - I met the Head of the IIO as part of an ongoing initiative of driving collaboration between our industry and the Presidency.</li> </ul> <p><strong>State plan for SOEs</strong> - As CESA is a member of BUSA, I also had the opportunity of attending a meeting of the NEDLAC Forum where a presentation was made on Government's Plan for some of the major SOE's, kindly <a href="http://www.cesa.co.za/uploads/NEDLAC_Exco_Presentation_06_December_2019.ppt"> click here</a> to access the presentation.<br /> <br /> <strong>DPWI unlimited liability requirement</strong> - Having met with the WC Provincial Roads Dept and agreed a way forward in rationalising its liability requirements in its SLAs, CESA has successfully approached DPWT (National) in this regard and is in the process of arranging a meeting to rationalise its unlimited liability requirements. <br /> <br /> <strong>Tender Irregularities</strong> - It is gratifying to report that following a complaint from a member firm, CESA was instrumental in achieving the cancellation of a tender administered by Mvula Trust for the 'Appointment of Multi-Disciplinary Team of Professional Service Providers for a W&S Programme at 36 Eastern Cape schools', as the tenders were not opened nor recorded at the tender closing. We cannot tolerate this blatant disregard for transparency in the public procurement process and we are busy engaging ACSA over a similar transgression in a recent tender in the Eastern Cape.<br /> <br /> <strong>Construction Sector Charter Council (CSCC)</strong> - The closure of the Council appears imminent as the funding problems have persisted and as it appears that there are no willing funders. <br /> <br /> <strong>BEPEC</strong> - As reported in the previous newsletter, BEPEC is experiencing funding difficulties and unfortunately has had to be liquidated. <br /> <br /> <strong>PPGI EBEIS feedback</strong> - Engineering News reported in an article entitled "Public, private sector collaboration bearing fruit across various sectors" that a PPGI meeting between private sector leaders and government had been held earlier in the week of 24 Jan 2020, where it was noted that representatives from the <a href="https://www.engineeringnews.co.za/topic/construction">construction</a> sector (EBEIS) appealed for fit-for-purpose procurement frameworks within government. For more details <a href="http://www.infrastructure-intelligence.com/article/dec-2019/fidic-launches-new-subcontract-plant-and-design-build?utm_medium=email&utm_source=transactional&utm_campaign=weekly-email"> click here</a>.<br /> <br /> <strong>South African Forum for Engineering (SAFE)</strong> - CESA attended the SAFE Meeting held on 22 Jan 2020 where discussion included the intention of Minister Blade Nzimande to place the CETA under administration, progress with the PPGI EBEIS initiative as it relates to the construction sector, the serious delays by SABS in approving & publishing new Codes, the new engineering qualifications, DPWI initiatives wrt EPWP and the forthcoming elections to ECSA (and the need for member firms to nominate engineers from their staff as candidates for ECSA).<br /> <br /> <strong>Built Environment Professions Grouping (BEPG)</strong> - CESA attended the BEPG Meeting held on 24 Jan 2020 where discussions included input into the CBE Fees & IDOW Committee as well as: <br /> · The Ergonomic Regulations (OHS Act) promulgated in December 2019, which Designers must take into account and stipulating that every workplace must have an ergonomic assessment. For promulgation <a href="http://www.cesa.co.za/uploads/Ergonomic_Regulations_2019.pdf">click here</a>.<br /> · The draft Regulations for Land Reform (rural development), which are open for comment for 60 days.<br /> <br /> <strong>Construction Industry Conversations (CIC)</strong> - CESA has learnt about the CIC initiative through its involvement in the BEPG, where the Association of Construction Project Managers (ACPM) is also a member. The CIC is an industry engagement forum of the ACPM that is aimed at amongst others at addressing the topics that enhance and threaten the Construction Project Management Discipline. Members are invited to attend the 6th session of the CIC, for more details kindly <a href="http://www.cesa.co.za/uploads/Overview__Construction_Industry_Conversations_2020.docx"> click here</a>.<br /> <br /> <strong>Aon Annual Presentation</strong> - As reported previously, Aon presented the Annual Report for the CESA PI Insurance Scheme at the CESA Quality, Risk& Sustainability Committee meeting held on 25 Nov 2019. Important points for members attention emanating from the Annual Report are:</p> <ul> <li>Members tend to forget the need for non-technical insurance for Directors and Officers. There is a small amount provided under the PI policy, but a bigger separate policy is required that also covers cyber risk</li> <li>Claims are largely the result of inexperienced engineers, discounting (although clients are beginning to limit discounts recognising 'that you get what you pay for'), cost overruns and fast tracking.</li> <li>It is critically important that members notify their PI Insurers of potential claims otherwise the Insurers can refute the claim should it materialise.</li> </ul> <p><strong>The Negligent Agent -The Ambit of the Agent's Liabilities under the JBCC</strong> - Interesting article on Clause 9.2 of the JBCC PBA, in the MDA (legal firm) newsletter explores this topic, to access the article <a href="http://www.cesa.co.za/uploads/JBCC_Oct_2019.pdf"> click here</a>.<br /> <br /> <strong>Sustainability - GRI Jan 2020 newsletter</strong> - Members are encouraged to read the latest monthly newsletter from GRI, provider of the world's leading and most widely used sustainability reporting framework - the GRI Standards. There is a strong focus on the latest topic added to the GRI Standards family - GRI 207: Tax 2019.
