				Procurement Bill - We circulated the new 
				Public Procurement Bill to Mandated Principals, Board and 
				Council members on 20 Feb 2020 for direct comment to Treasury 
				and copy to CESA, in order to maximise the number of comments. 
				The deadline for comments is 31 May 2020. CESA will be sending 
				comment from an industry-wide perspective, but we are calling on 
				members as individually interested and affected parties to make 
				your voices heard as well. 
				&nbsp; 
				ECSA Fee Guideline - Members will be pleased to 
				learn that the drafting of the new ECSA Guideline Fees finally 
				got underway with the first meeting of the Task Team taking 
				place on 13 Feb 2020. As reported previously a number of the 
				CESA Supply Chain Mgmt Committee members serve on this Task 
				Team. At this stage it is envisaged that the new Guideline Fees 
				will be approved at the August 2020 meeting of the ECSA Council. 
				&nbsp; 
				CESA Council meeting on 19 February 2020 - The 
				meeting held at the CESA Head Office in Johannesburg, presented 
				an opportunity for members of the Board and Branch Chairpersons 
				to discuss and debate the severe challenges facing the 
				consulting engineering industry on a regional basis. It would 
				appear that many of the challenges are similar and where 
				possible CESA will be addressing these with national entities 
				such as SANRAL.

		Benefits of CESA Membership - One of the primary 
		benefits of CESA membership is the ability to request CESA to take up 
		matters with Clients anonymously on your behalf. We have recently been 
		informed that a major client has ruled that tenders from entities that 
		are in dispute with the Client, will not be entertained. Whilst this may 
		be the prerogative of the Client, which is normal business practice if 
		two parties are in dispute, we would hope that once the dispute has been 
		resolved amicably, that such a company should be eligible for 
		consideration for future projects. It should be borne in mind that 
		though we are not in a position to intervene when there is already a 
		contractual relationship in place, we can assist with dispute avoidance 
		prior to a tender closing stage. We urge you therefore, not to hesitate 
		to share these instances with us timeously so that we can intervene if 
		appropriate to do so, on your behalf and in the interests of the 
		wellbeing of the industry.

		#CESAIndaba2020 - Join us at the Annual CESA 
		Infrastructure Indaba at the Spier Conference Centre, in the 
		Stellenbosch Winelands on the 11 and 12 March 2020. The conference 
		provides members with an opportunity to hear first-hand from clients and 
		engage with them to solve problems in the infrastructure ecosystem. Some

		Investment in Infrastructure -&nbsp; Consistent with 
		the previous interactions we shared with you, on our engagements with 
		the head of the Investment and Infrastructure Office (IIO), in&nbsp; of 
		the Presidency, Dr Kgosientso Ramokgopa, the CEO and President of CESA 
		attended an engagement hosted by President Ramaphosa at Tuynhuys on 18 
		February 2020 attended CEO's of key Business Institutions, Country Heads 
		of Banks and Funding Agencies. The objective of the meeting was to share 
		with the private sector, the process that would be implemented to 
		identify economic infrastructure projects that would be showcased to 
		attract private investment where government will play a significant role 
		in expediting regulatory approvals, such as EIA's, SPLUMA and WUL which 
		normally take much longer than they should to fast track implementation 
		of these projects. The next step in the process is the planned 
		Sustainable Infrastructure Development Symposium (SIDS) in May this 
		year, to which project owners and funders will be invited to start the 
		process of relationship building and any due diligence steps required to 
		commence with further development and implementation of identified 
		projects. You will all have received a request from the CEO on such 
		projects, that you may be aware, of which we hope to share with the IIO 
		in due course for further consideration.

		CESA Committees - As members are aware, CESA has a 
		number of standing Committees of the Board, each with its own TOR and 
		chaired by a Director of the Board, to assist the Board and the 
		Directorate with the implementation of the CESA Strategic Plan and 
		related policy issues. The Committees generally meet quarterly and draw 
		their membership mainly from the active and retired staff of member 
		firms as well as key stakeholders such as Aon.

	Affairs, Procurement &amp; Membership</h1>

	Affairs Queries - In order to answer the question often asked about 
	&nbsp;the value of membership, we have developed a simplified graph depicting the 
	frequency and type of queries that CESA dealt with in 2019. We will be 
	sharing more of this type of information with you in the future editions of

		Procurement related meetings - During February 2020, 
		CESA attended the following procurement related meetings with public 
		sector clients/bodies:
		<ul>
			<li>&nbsp;JRA meeting on 7 Feb 2020 - JRA indicated 
			that following CESA's earlier intervention they had cancelled the 
			recent JRA "Bridge maintenance tender", which saw a non-engineering 
			firm overseeing the bridge condition assessment and maintenance 
			programme, and had subsequently implemented an "inception phase" for 
			all projects to ensure that service providers have the necessary 
			resources and skills required to execute the projects.</li>
			<li>DPWI meeting 11 Feb 2020 - The problematic DPWI 
			"unlimited liability" requirement in their SLA for professional 
			service providers was discussed as well as the poor performance of 
			consulting engineers in managing variation orders and the 
			certification of work on site. It was agreed that the DPWI would see 
			to the revision of the CIDB's PSC with respect to the liability 
			clauses after sufficient consultation and due consideration has been 
			given to the matter and manage disputes with contractors via the 
			contractual dispute resolution process. It was also agreed that CESA 
			would ascertain the views of the other built environment professions 
			(BEPG) regarding the unlimited liability requirements and share 
			these with DPWI.&nbsp; 
			The meeting concluded with CESA inviting DPWI to raise any 
			complaints regarding member firms with CESA who will address same in 
			terms of our code of conduct </li>
			<li>Meeting with the Office of the Chief Procurement Officer 
			(OCPO) on 17 Feb 2020 - This was a follow up meeting with 
			OCPO, attended by CESA, SAICE, SAFCEC &amp; CBE, representing Industry, 
			with following outcomes:<ol>
				<li>to review the R20 million variation order limit 
				and consider a maximum percentage of the cost of works rather, 
				as had been the practice in the past;</li>
				<li>to remind public sector entities that they could mitigate 
				against the risk of the three-year contract limit cutoff 
				which is impractical and wasteful especially when projects are 
				incomplete, provided that they plan adequately and communicate 
				the correct envisaged project stages and timeframes with the 
				OCPO when the project award commences;</li>
				<li>to improve on the communication and understanding of the 
				application of the thirty percent subcontract 
				requirement in accordance with the PFMA which relates 
				to Public Sector developments only, which has in some cases been 
				misinterpreted by various communities and in cases has created 
				an opportunity for criminal activity where money is extorted 
				from Contractors in the form of "protection fees" rather than 
				direct involvement for compensation in the project itself;</li>
				<li>to enter into more dialogue on the status of the 
				drafting of state-owned contracts which is deemed 
				unnecessary by Industry. Whereas the OCPO pointed out that 
				existing contracts did not address issues such as empowerment, 
				it was pointed out that such requirements could always be added 
				as Special Conditions of Contract and that it was not necessary 
				to "reinvent the wheel" as it were;</li>
				<li>to review the recent circular issued to Municipalities to
				pay engineers on "time &amp; cost" basis only 
				whereas there is a need for percentage fees in the 
				infrastructure development environment when project scopes are 
				poorly defined and critical information, such as geotechnical 
				studies are not available at the time that Consulting Engineers 
				are required to submit bids for prospective projects.</li>
			</ol>
			</li>
		</ul>
		DPWI Working Committees - CESA has nominated two of 
		our managers to sit on the newly established DPWI Working Committees, 
		being the "Procurement" and the "Skills Transfer" Committees. These 
		committees will be administered by CBE. It is hoped that they will add 
		value to the construction sector/ delivery of infrastructure.
		Forms of Agreement (FOA)
		<ul>
			<li>&nbsp;Revision of CESA Forms of Agreement - The 
			CESA FOA, has been reviewed and is currently with a legal adviser 
			for comment. Thereafter it will be circulated to the Supply Chain 
			Mgmt (SCM) Committee for comment/approval. Next the CESA Short Form, 
			Sub-consultancy &amp; JV FOAs will be revised and aligned to the revised 
			FOA</li>
			<li>PROCSA - Next meeting on 4 March 2020, where 
			the revised engineering Scopes of Services pertaining to the PROCSA 
			Agreements sourced from industry will be tabled. Looking at revising 
			the Matrix to align with version 4 of the Agreements</li>
		</ul>
		Practice Notes (PNs) - The revision of the PNs is 
		approximately 30% completed. The PNs relating to "Fees" have been 
		included in the Fees Manual/ Practice Note. The SCM Committee will 
		shortly commence reviewing the revised PNs. Once the revision of the PNs 
		is completed it is proposed to hold a PN seminar/s as in previous years. 
		Members are also reminded to make use of these PNs that are reserved for 
		their use only. The PNs can be found on the Members Section of the CESA

		obtained by phoning CESA's Ms Gillian Wands at 011&nbsp;463 2022 during 
		office hours.
		Mandatory member-systems - These are the CESA 
		Quality Management System (QMS 2011), the Business Integrity Management 
		System (BIMS 2009) and the Sustainability Framework (SF 2013), which 
		require updating to reflect changes in standards and current thinking.
		 
		Rather than updating the existing systems, it is intended to base the 
		new CESA systems on the more modern equivalent FIDIC systems. 
		The System Questionnaires that serve the dual purposes of guiding 
		members in the implementation of these systems and assist in monitoring 
		member compliance are being developed and reviewed by members of the 
		Quality, Risk &amp; Sustainability Management Committee.

		reminded that CESA will wherever possible assist them with advice 
		pertaining to procurement issues, roles and responsibilities, the ECSA 
		Fee Guidelines &amp; Scope of Services, contract documentation, PI issues

		assistance is regarded as a benefit of membership intended for member 
		firms, their clients and the public, and is not for consulting

		Development Programme - The 2020 BCE Development Programme's 
		first block week/contact session will take place from the 2nd to the 6th 
		March 2020. This programme equips young engineers to be highly 
		productive, effective, efficient and confident with the non-technical 
		skills that are not covered in their normal tertiary engineering 
		qualification.&nbsp; This first part of the programme will be presented

			<li>The FIPDM's seminars have been put on hold, as CESA has been 
			advised that there have been various challenges in aligning FIPDM 
			with the IDMS and the transition of the IDMS from Treasury to DPWI, 
			as per the SONA announcement. Also, the IDMS modules are currently 
			being reviewed by the provinces, and therefore the latest version of 
			the IDMS is not a public document., In view of this the SCE has made 
			the decision to&nbsp; place this training on hold.</li>
		</ul>
		HR Forum - The next HR Forum meeting will be held on 
		the 10th March 2020. Mr. Thamsanqa Maqubela, the Executive Chairman of 
		the South African Council for Graduates Co-operatives (SACGRA), will be 
		doing a presentation on internships, WIL and candidacy programmes that 
		SACGRA funds, and how member firms can get funding by hosting graduates

		CESA Aon Engineering Excellence Awards 19 August 2020 - Call
