<ul><li>The good news is that we are finally getting to grips with the <strong><em>Construction Charter and Scorecard</em></strong>. On Wednesday last week the Charter Group met to examine the comprehensive third party review and analyse the differences between the requirements of the generic Charter and our Charter. SAACE was well represented and we had a very constructive meeting where we reached tentative agreement on these issues and hope to finalise our position on the 15<sup>th</sup> August so as to submit for a Section 9 approval and gazetting by Government. As soon as we reached clarity, including the applicable turnover ranges for BEP's, we will circulate the document to all Mandated Principals. <br /><br /></li><li>I circulated the Draft Proposals by the CIDB concerning the proposed <strong><em>Register of Professional Service Providers </em></strong>to Mandated Principals. Comment has been received from a number of small firms expressing their concern at the applicable turnover ranges specified in relation to project size. This is just to assure you that we will carry forward the concerns to the CIDB and try to establish a less restrictive set of conditions for access to work by smaller firms. Some of the concerns were brought about by a misunderstanding however, and a misinterpretation of the intent. The relationship between turnover and project size related to the consultancy service only and not project value. In addition, there is no restriction on the number of projects to be accessed annually within the range.<br /><br /></li><li>On the subject of our requirements <strong><em>requiring members to have in place a Quality Management System in place</em></strong>, our Quality & Risk Management Committee, under instruction from Council and Exco, are examining a number of suggestions to make the requirements less onerous on small firms and particularly single practitioners whilst at the same time not detracting from the seriousness of our intention to differentiate our members in the market on the basis of quality - more on this later.<br /><br /></li><li>We are putting the final touches to our <strong><em>Conference programme which is to be held from the 7 - 9<sup>th</sup> October at the Lord Charles Hotel in Cape Town</em></strong>. A special request goes to the consulting fraternity to register and give us your support. I am sure you will find the programme of value and the time out interacting with your colleagues well worth it. As usual, registration from our SAFCEC contractor colleagues far exceeds those by consultants. <em><u>Please refer Marketing Desk</u></em>. <br /><br /></li><li>Many thanks for the fantastic support from firms who have submitted their <strong><em>Management Information Survey (MIS) questionnaires</em></strong>. Increasingly the information is seen to have real value. It certainly helps the Association articulate on issues affecting our industry with considerable confidence. Once again we have improved and tried to clarify some of the rather nebulous questions and next time round we are going to include questions relating to quality, risk and cost of PI in relation to claims history. We intend using this to challenge the insurance market, to make it more open and transparent with a view to lowering your costs but we will need your input. The first questionnaire on this latter aspect may go out separately as we cannot afford to wait a further six months to embark on this process.<br /><br /></li><li>It is confirmed that our <strong><em>Procurement Indaba will take place at Emperor's Palace next to OR Tambo International Airport on the 12 February 2008</em></strong>. We are finalising the programme to ensure that we as an industry take a firm position in relation to the requirements of procurement legislation including interrogating our business model. Clients will not be invited to this first round, however, there will be a Procurement Road Show to branches thereafter which will include a presence by clients. Those 60 individuals that have already registered prior to the postponement will be carried forward and treated as "early bird" registrations in terms of cost. We hope to attract 300 delegates and we intend inviting high profile speakers able to influence policy. Please make a note of this event in your diaries, official invitations will be sent out as soon as the programme has been finalised.<br /><br /></li><li>I am embarrassed to report that the intervention in respect of <strong><em>Disaster Management for the Eastern and Western Cape</em></strong> has not progressed any further due to non response by Dplg. This despite the fact that they approached us for assistance. Nevertheless, we are progressing with the creation of a Section 21 SPV which will serve as a platform to extend our municipal support programme as well as give assistance to DWAF as required by them.<br /><br /></li><li>Just a short reminder that the <strong><em>Association will continue to challenge illegal procurement notices by client entities</em></strong> and in cases where members respond to repeat tenders within the 6-month period, the Association will have no option but to take action in terms of its Constitution. Quentin Koen has taken legal advice to ensure that there are no negative legal implications - <em><u>see Contractual Affairs Section</u>.<br /><br /></em></li><li>A free copy of the long awaited <strong><em>Risk Management Manual</em></strong> is to be sent to the Mandated Principal of each firm under a covering note explaining that it will form part of a course to be conducted under the auspices of the School of Consulting Engineering (SCE) later this year. <p>Just to let you know Roelof is progressing well and recovering from his accident, however, it is going to take time and he has indicated that he will be back in the office at the end of August. <ul><li><strong><em>Legal opinion on repeat tenders: </em></strong>The SAACE has obtained legal opinion regarding the legality of clause<strong><em> 2.7 of the SAACE Code of Conduct</em></strong> in terms of which members of the SAACE shall not "without satisfactory reasons, submit a proposal, whether priced or un-priced, for the same or substantially the same project for which proposals have previously been submitted to the same body within the preceding six months".<br /><br />In determining the legality of the clause, regard was had to the requirements of the SA Constitution 1996, as well as that of the Competitions Act 1998. In terms of the conclusion of the legal opinion, clause 2.7 above would survive any challenge based on the provisions of the Constitution and would not constitute a restrictive horizontal practice in terms of the Competitions Act. Any suggestion that it might restrict competition in the marketplace is outweighed by the pro-competitive gain as reflected in the SAACE Client Information Sheet 4 on how to handle repeat tenders. <br /><br /></li><li><strong><em>Client Information Sheet for the week: <br /><br /></em></strong><strong>How to handle repeat tenders: </strong>There are currently four client information sheets. <ol><li><strong><em>School for Consulting Engineers (SCE)</em> </strong>had its committee meeting on the 1<sup>st</sup> August 2007. We would like to welcome <strong><em>Johan Durand from CKR (Pty) Ltd</em></strong> Consulting Engineers who joined the committee. <br /><br /></li><li><strong>CETA Conference: </strong>The <strong><em>CETA Conference</em></strong> was held on the <strong><em>30<sup>th</sup> & 31<sup>st</sup> July</em></strong> <strong><em>2007.</em></strong> On the first day there were structured presentations. On the second day, CETA requested that all the sectors within their SETA give a presentation addressing the issues of what human resources currently exist, and what human resources will still be required to overcome the skills shortage (together with suggestions as to how the shortage issue should be remedied). Although many suggestions were tabled, for the most part, most sectors did not have actual accurate figures available. It was agreed that a follow up meeting would be set up in a few weeks time to present these figures.<br /><br /></li><li><strong><em>CETA: </em></strong>Much deliberation has centred around the issue of whether SAACE and the other Built Environment Professionals (BEP) should or should not continue to investigate the possibly of moving to another SETA. <strong><em>The Minister of Labour,</em></strong> <strong><em>Mr. Membathisi Mdladlana,</em></strong> <strong><em>has announced that the current SETA structure will only remain until 2010. </em></strong>What will follow will be a radical restructuring and reduction of the whole SETA structure, with only 5 SETA's remaining. As only two and a half years remain and the whole investigation and change process would probably take close on 2 years to complete, together with the conflict which would no doubt arise, it would hardly seem worth while for the sake of 6 months of participation before the whole structure changed. <br /><br />The Standing Committees of CETA have been re-aligned to prevent meaningless duplication in terms of effort in all Standing Committees. The BEP Standing Committee has an agenda which relates only to issues of immediate relevant importance to the BEP's. <strong><em>Erwin Sonnendecker, the newly</em></strong> appointed <strong><em>Chief Operating Officer,</em></strong> attends these meetings so all relevant matters receive the necessary attention. <br /><br />It has been agreed that the following 4 issues are the major priorities for the BEP's, and that these must receive attention from CETA Management and from Exco and Council.<br /><br />1. Learnerships for all Professions that are initiated from entry into tertiary education until final registration.<br /><br />2. Amendment of the Workplace Skills Plan so that Professionals can be assured that most of their training needs are met before a Professional enters the workplace. This should happen during tertiary education.<br /><br />3 The funding of research into the actual needs and shortages in the Professions, and how these can be addressed in a co-ordinated manner by all role players.<br /><br />4. Ring fencing of the Professional's contribution to CETA.</li></ol><ul><li><div><strong>LLLS News: </strong><a href="news:DVD"><br /><br /></a><strong><em>DVD Engineers in Practice Update: </em></strong>A menu function will be added to the DVD's to improve the search function in play mode. This function will also enable LLLS to add downloadable documentation onto the DVD's.
