<ul><li> As you can imagine the event that consumed all of our energy over the last few days was the <strong><em>Construction Conference</em></strong> which, for me, proved to be a challenge of note. Trying to cater for the needs of 11 rather diverse organisations was very difficult indeed. In fact, it was like trying to "herd cats" which as you know can be problematic. The Minister arrived an hour-and-a-half late with protocol allegedly preventing us from going ahead and one of the key speakers pulled out at the last moment. The theme of the conference was about "unity" but from the presentations proved to be anything but. Not wishing to be too negative I must say that the functions were okay and the input on the second day relating to the supply demand issues in regard to skills, was very useful. As far as the conference is concerned, next year needs to be radically different with no politicians being invited. In addition, perhaps speakers need to be external to the individual organisations so that we do not have politicking from the floor and a professional Master of Ceremonies needs to be considered. We will also call for proposals when appointing a Conference Organiser with some strict KPA's. <br /><br />During our <strong><em>AGM</em></strong> however, we had a very fruitful discussion lasting about an hour on the subject of tendering for professional services, discounting, quality based selection etc. We will revisit this very important debate at a workshop to be held on the 13 February 2007 to which the CEO's, or their nominees, from each of our firms will be invited. Please make a note of this date because as an Association we have to, once and for all, develop a policy position on these key issues and agree on a business model that will work for our industry. This morning we workshopped the day's agenda for the Indaba and will be communicating with you all shortly with an invite to participate in this key debate. <br /><br />We are very pleased to welcome <strong><em>Mr Cecil Rose on board as President for 2006-2007</em></strong> and wish him every success in his endeavours. <strong><em>Other Office Bearers</em></strong> inducted were as follows:-<br /></li><ul><li><strong><em>Felix Fongoqa</em></strong> (Iliso Consulting) - Deputy President</li><li><em><strong>Zulch Lötter</strong></em> (UWP Consulting) - Vice President</li><li><strong><em>Webster Ndodana</em></strong> (Ndodana Consulting) - Past President<br /><br /></li></ul><li>On the 23 October the Association met with the <strong><em>Department of Provincial and Local Government (DPLG) </em></strong>in Pretoria at their request. This was on the MIG side rather than on the Project Consolidate and revolved around a request to the Association to support them in capacitating local authorities. A number of interventions were agreed, one of which involves discussions with ECSA and others concerning the possible registration of a new category of a professional whose main function would be to assist local authorities in their technical/managerial endeavours but who could migrate to the technician/ technologist level over a period of time. With the loss of staff and corporate memory many local authorities no longer have records of the services they are supposed to render. This would include details of storm water/sewerage/water reticulation. There has been a request for our firms to voluntarily supply any information they may have but on the basis that the firms in question are not exposed to undue risk in handing over their intellectual property. Many other issues were discussed but space precludes a detailed feedback at this stage.<br /><br /></li><li>At the <strong><em>Quality & Risk Management Committee Meeting</em></strong> on the 26 October our long awaited Risk Management Guildline was tabled as a draft. We would like to issue it before the end of the year but need to get some comment on the document as it is very civil engineering orientated and needs to consider the electrical/mechanical disciplines as well. A workshop has been arranged to take place on the 6 December at the offices of Glenrand MIB from 08h00 to 11h00 to workshop and finalise the document. Anybody who feels that they can add value to the debate is welcome to attend, but we have set a limit of 20 attendees to ensure efficient debate. It will be on a first come, first served basis and you are requested to contact Jean Stanford to reserve a place and to get an advanced copy of the draft guideline. <br /><br />The good news is that the <strong><em>PI Scheme</em></strong> is still healthy although there has been a slight upturn in claims relating to structural and geotechnical work. We have also been warned that, as in the past, any upturn in the availability of work inevitably precedes an increase in claims particularly in the categories of work already mentioned - please take note. Two Advisory Notes will be issued before the end of year, one relating to Performance Bonds and the other relating to Public Liability. In addition, our Advisory Note concerning the Construction Regulations is being updated for issue later in the year. This latter note will deal more comprehensively with the concept of the engineer acting as Agent and this follows discussions we have had with the National Department of Public Works (NDPW)and the Department of Labour (DOL) who are starting to see things the SAACE way. <br /><br /></li><li>The long awaited debate on the <strong><em>CETA forensic audit</em></strong> took place last week and as a consequence we have some serious decisions to take as the built environment professions. After a caucus meeting with the affected parties it is likely that presentations will be made to the respective Councils regarding their continuance, or otherwise with the CETA, but more of this later after the debates have taken place.<br /><br /></li></ul><p><strong><em>Graham Pirie <br /></em></strong></p>

<ul><li><strong><em>CIDB - </em></strong>A CIDB technical meeting will be held at the offices of the CIDB on 15 November to discuss issues related to generic Scope of Works. <br /><br />The Construction Industry Council (UK) (CIC) has recently released, for comment, an exposure edition of a Consultant's Contract for the appointment of Consultants on Major Construction Projects complete with a generic scope of services, copies of which may be downloaded from <a href="http://www.cic.org.uk/ConsCon/index.shtml">www.cic.org.uk/ConsCon/index.shtml</a>. <br /><br />The CIDB has made contact with the CIC who have indicated that they are prepared to discuss the use of the generic scope of services in South Africa with or without modifications.<br /><br /></li><li><strong><em>Construction Regulations - </em></strong>A meeting was held on the 25 October 2006 with the Department of Labour's Manager: Inspection and Enforcement Services, myself and a representative of Glenrand MIB who has extensive knowledge on the Construction Regulations. This meeting was a major breakthrough for us, since we have been struggling to liaise with the Department since comment on the Construction Regulations was sent to them in March 2005. The Department's representative, a Civil Engineer, stated that he would purport to issue a directive pertaining to the issue of a designer being liable for his design, even if it is used without his knowledge on a site totally different to the location of the original design. He was appalled of the fact that the Regulations could be interpreted in such a manner.<br /><br /></li><li><strong><em>Advisory note for the week</em></strong> - <strong>Skills Development Act And Associated Acts (search code 00/7). </strong>The advisory notes on the SAACE website cover a wide field of topics, ranging from business practice to risk management. <ul><li><strong><em><a href="www.ecsa.co.za ">ECSA</a> - </em></strong>A short note from the Chairman of the Identification of Engineering Work (IDoEW) Committee, Mr Ivor Evans:<br /><br />"Phase II of ECSA's IDoEW Project spearheaded by the Chairperson and Project Co-ordinator will focus on the marketing of the Proposed IDoEW Regulations and the engagement with critical stakeholders and/or industries. To this end the frequency of the meetings of the IDoEW-SC will probably reduce to once-a-quarter. As Chairperson of the IDoEW-SC, and also on behalf of the ECSA Council, I have great pleasure in congratulating the team with a job well done and also to express my sincere appreciation for your personal sustained commitment and exceptional contributions over this prolonged period without which this significant achievement of this long awaited goal would not have been possible".<br /><br /></li><li><strong><em><a href="http://www.llls.co.za/">Life Long Learning Solutions</a></em> - </strong>ECTV Engineers in Practice 2006 comes to an end at the end of January 2007 with the second series starting in February 2007. <br /><br />The final broadcast of <strong><em>Engineers in Practice 2006</em></strong> was aired on DSTV on Wednesday night, 1 November. A total of 814 engineering professionals have participated in this training programme during 2006 and each of these professionals attained the one compulsory credit in Category 1 of ECSA's CPD policy. Certain of the delegates who attended the Construction Conference and participated in the SAACE AGM, attained a further one Category 1 credit and one Category 3 credit, giving them a total of three credits for developmental activities. Add to this the additional 2 credits they can be awarded for their work based activities in Category 2 and these individuals have attained their five credits for 2006! - it really is that easy to be compliant with ECSA's CPD policy.<br /><br />The positive outcome of the Engineers in Practice series has prompted SAACE to continue with the programme in 2007. As mentioned earlier, the first programme in the new series will be during February. A survey will shortly be done to establish whether or not subscribers prefer the joint broadcast and DVD channels or whether they have a preference for one or the other on its own. This will inform any changes to the method of distribution for 2007.<br /><br />Please note that if you did not participate in 2006, you can still order the 10x DVD set at R1200 excl VAT, Postage and Packaging. <ul><li>The IBDS had some important interactions with the DTI in the last two weeks. <strong><em>The Arabian Gulf Export Group (AGEG)</em></strong> had a meeting and substantial progress was made around the strategy that will be followed to place a suitably qualified person who can pursue specific large project opportunities in the Gulf Region, in accordance with the business plan prepared for the functioning of the AGEG. The most important principle that was established during this meeting was the fact that the DTI need to fund all the initial costs, collaborate with the private sector and secure some projects first, before members are asked to participate financially. The IBDS will take the leadership in this regard and apply for the necessary funds and ensure that its members remain at the forefront of this exciting development.<br /><br /></li><li>After attending the Construction conference earlier in the week, Roelof attended the final <strong><em>Export Council Meeting</em></strong> of the year over two days at the Department of Trade and Industry. A consultant report for the formation of Trade Hubs in lucrative markets, similar to that of many other countries (Australia, Malaysia and China) was one of the concepts that were discussed and accepted by the Export Councils. The DTI has therefore been requested to include this as a new service offering. In practical terms what a Trade Hub would do could take many forms. One form it could take would be the setting up of some office space (meeting rooms) and related services (including secretarial and translation services) in countries like Angola or the DRC. While there may be some user charges to avoid abuse, the objective would be to provide "free" office support to bring down the cost and risk of penetrating these markets. In more developed markets the emphasis of trade hubs could be on different issues as office space and translations services might not be as scarce or expensive. <br /><br /></li><li>Finally, as many of you would know one of my most important jobs with the <strong><em>DTI</em></strong> is to not only secure access to it incentives for members, but to make it less bureaucratic and appropriate. In response to our engagement in this regard the DTI has started a new concept called <strong><em>International Trade Initiatives (ITI)</em></strong>. This is not the forum to go into all the advantages of this initiative, but suffice to say that it is a new approach that will address many of the traditional problems related to visits to foreign markets. <p>A group of five Danish highly specialized companies - amongst the most competitive in the European market - in the constructional and production business are looking for a South African co-operation partner (small or medium sized company) who would join them as a long term partner in a Danida project - The Danish Ministry of Foreign Affairs. Danida demands that at least 25,1 % of the South African company should be owned by black people.
