<ul><li>By the time you read this newsletter Webster Ndodana and I would have just completed the <strong><em>presidential visit to Northern Province and Mpumalanga.</em></strong>&nbsp; This time we enjoyed the pleasant company of Deputy President, Cecil Rose, who will be doing the rounds during 2007.&nbsp; <strong><em>The final visit for the year takes place on the 17<sup>th</sup> and 18<sup>th</sup> August, ie Mafikeng and Potchefstroom.</em></strong>&nbsp; It is hard to believe that we are well into the year and before we know it, it will all be over, with FIDIC in September and our Construction Conference in October. <br /><br /></li><li>A milestone was achieved last week, when after intensive negotiation and debate, <strong><em>we finalised our MOU with the DPLG</em></strong> in regard to the local authorities support programme.&nbsp; All that has to happen now, hopefully, is for it to be signed by the Department.&nbsp; &nbsp;Cederberg is still on ice and we are about to start meaningfully in Greater Kokstad.&nbsp; Tsantsabane, JS Maroka and Mahkudutamaga are &quot;going like a boeing&quot; while there is pressure on us to launch a further support programme in Mafikeng.&nbsp;&nbsp;Prior to launching the Mafikeng initiative we will put out a call for Expressions of Interest and then we will do a suitable match in conjunction with the local authority as we have done with the others.&nbsp; We have also had&nbsp;discussions with the DBSA with a view to bringing them into the partnership.&nbsp;<br /><br /></li><li>The office has become a little tense over the last few weeks as we fast approach our <strong><em>SAACE Glendrand MIB Business Annual Excellence Awards which takes place after Council on the 2<sup>nd</sup> August.&nbsp;</em></strong>&nbsp; All the planning is in place and the attendance looks good so here&#39;s hoping for a great evening of entertainment.&nbsp;&nbsp; <br /><br /></li><li>Of late I have been overwhelmed with commentary and complaints from many of our members, including the YPF, concerning <strong><em>unrealistic pricing for projects&nbsp; submitted to clients by our member firms.</em></strong>&nbsp; There seems to be a growing frustration with&nbsp;the rates submitted by our members where it has to be asked &quot;are firms able to deliver quality services with limited risk at the low costs tendered&quot;?&nbsp; It is hard to believe, if we are reading the situation correctly, some of the huge &quot;discounts&quot; being offered to clients.&nbsp; This is difficult to comprehend especially since we are in a sellers market, but it seems to me that many Engineers consider winning the project more important than any profit that might follow.&nbsp; Some of these &quot;unrealistically high discounts&quot; may mean that elements of the work have been excluded through some sort of variation, or not.&nbsp; I have asked one of our partners, Leads 2 Business, to see whether they can generate some sort of confidential report giving us details of the various projects over time so that we can actually come to some sort of realistic conclusion as to the wide scatter of&nbsp;tender values&nbsp;and the sometimes massive discrepancies that occur&nbsp;between the highest and lowest prices submitted.&nbsp; Incidentally, this is a major issue for our young professionals who see our business culture as being somewhat unsustainable and leading, in the end, to unrealistically low salaries in relation to other low risk professions.&nbsp; One of our strategic interventions in the year ahead is to examine and try to understand our business culture and the way we operate in the market place as a collective with a view to inculcating a sustainable business mindset amongst the broader member base.&nbsp; We are considering providing a facility on our website where hot topics such as this can be debated on a confidential basis amongst member firms since we really need to get to the heart of many of the frustrations that I receive &nbsp;almost daily from members.&nbsp; To quote one such member who &quot;gets the vision of a pack of rabid dogs&quot; when he sees each of our firms having to win each and every appointment available in the market at any cost and thus not doing&nbsp;anyone a favour.&nbsp; He goes on to say that the professionals cannot afford such a struggle and need to provide more stability to our professional environment.&nbsp;&nbsp; The Competitions Commission prevents industry colluding&nbsp;on price, but nevertheless we do need to understand better the business dynamics of creating a sustainable, healthy and growing profession.&nbsp;&nbsp; Engineers do it to Engineers.&nbsp; Why? <br /><br /></li><li>You may remember some months ago member firms were given the opportunity of a discounted membership of the <strong><em>Water Institute of Southern Africa&nbsp; (WISA)</em></strong> and as a consequence we circulated their rather elaborate and lengthy newsletter which was published every two weeks.&nbsp; Just to confirm, you will no longer receive the newsletter and that if you wish to continue receiving it,&nbsp;you will have to apply for membership as this publication is directed at members only.<br /><br /></li><li>The <strong><em>SAACE Consultants Relay</em></strong>, having exhausted our repertoire of firms willing to assist in organising this 22-year old event it was agreed a few years ago, to partner with one or other of our firms for a 3-year term to organise the event.&nbsp; Bigen Africa very kindly came to the fore and they have been running a very successful event which has grown in stature and variety during the period.&nbsp; Naturally the quid pro quo would be for the event to incorporate the name of the sponsoring firm but this has&nbsp;elicited some negative comment from some quarters, who have as a consequence decided&nbsp;not to participate. &nbsp;The 3-year term commences once again at the end of 2006 and a renewed call for partners to operate on a similar basis has resulted in a zero interest from amongst our firms - hence this insert.&nbsp; If we do not get any takers, the event may be compromised, but I am hoping that should this be the case, the current partners see their way clear to continue.&nbsp; The choice is yours - here is an opportunity to put in an expression of interest!!<br /><br /></li><li>The number of <strong><em>outstanding Annual Declarations</em></strong> which were due at the end of January of this year has now been reduced to 30.&nbsp; The next step involves a final appeal for the member firm to respond after which we will be left with no alternative but to deregister the firm at our next Council meeting.&nbsp; Some firms may have amalgamated and not informed us and this may be part of the problem. <br /><br /></li></ul><p><strong><em>Graham Pirie </em></strong></p>

<ul><li><strong><em>SANS 10400</em></strong> - The SAACE recently received information from some member firms that the above document was out for comment, and that it contained definitions purporting to reserve certain types of work for &quot;competent persons&quot;, as defined in that document.&nbsp;<br /><br />The definitions, specific to competent persons relating to the categories of dolomitic areas and structures, had additional requirements over and above being registered with ECSA.&nbsp; These requirements had the tendency to identify certain engineering work to be performed by certain categories of persons, and according to the member firms were in some cases very onerous in that they required excessive expertise to perform such work.&nbsp; Local authorities using the guideline document to determine if a person was competent to perform certain work, would use a stricter measure than ECSA.<br /><br />The SAACE submitted comment, urgently requiring the delay of the approval of the document until such time as the technical committee of Standards SA pertaining to SANS 10400 and representatives of ECSA had met to come to a conclusion on the desirability of the definitions.&nbsp; The reasoning behind the comment was that ECSA has the legal mandate, in terms of the Engineering Professions Act, to identify work to be performed by certain categories of persons, and that the SANS document was indirectly usurping this function.<br /><br /></li><li><strong><em>Advisory note for the week - </em></strong><strong>Guidelines For Insurance Of Construction Contracts (search code 85/12)<br /></strong>The advisory notes on the SAACE website cover a wide field of topics, ranging from business practice to risk management.&nbsp; They can be found at <a href="http://www.saace.co.za/">http://www.saace.co.za/</a>&nbsp; Under advisory notes, go to advisory notes for members, and do a search or view the whole list of topics.<br /><br /></li></ul><p>Contact Quentin Koen at (011) 463 2022 or email: <a href="mailto:quentinkoen@saace.co.za">quentinkoen@saace.co.za</a>.</p>

Watch this space for more exciting info. <br /><br /></li><li><em><strong>SAACE Bigen Africa Relay </strong></em>- Registration forms are available&nbsp;on the Bigen website, <a href="http://www.bigenafrica.com/">http://www.bigenafrica.com/</a>. <br /><br /></li><li><em><strong>SAACE Golf Day </strong></em>- This year&#39;s Golf Day will be held at Blue Valley Golf Estate in Midrand on the 25 August 2006.&nbsp; Last year&#39;s event was very successful and we received many requests from firms active in the built environment to participate.&nbsp; Members are therefore reminded that we rely on you to ensure client participation in this event.&nbsp; You are&nbsp;encouraged to think innovatively when considering invitations to clients and important role-players to participate in the SAACE Golf Day.&nbsp;<br /><br /></li><li><strong><em>IMESA / SAACE EXCELLENCE IN MUNICIPALITY ENGINEERING ACHIEVEMENT AWARDS 2006.&nbsp; </em></strong>A biennial competition organized jointly by the Institution of Municipal Engineering of Southern Africa (IMESA) and the South African Association of Consulting Engineers. &nbsp;This year&#39;s event will take place on the 10 - 13 October, at Vista University, Soweto. <br /><br /><strong>CALL FOR ENTRIES -</strong>The Institution of Municipal Engineering of Southern Africa (IMESA) and the South African Association of Consulting Engineers (SAACE) have pleasure in inviting local authorities or their engineering consultants to submit entries for their 2006 biennial Excellence in Municipal Engineering Achievement Awards competition. <br /><br /><strong>BACKGROUND - </strong>IMESA initially established the awards in 1986 to create awareness in the general public of the &quot;art and science&quot; involved in municipal civil engineering, as well as highlighting the innovative ways in which this profession finds answers to challenging problems. <br /><br />Municipal engineers plan, build, operate and maintain a variety of projects which include roads, bridges, housing, water supply projects, sewers, wastewater treatment works and other engineering facilities required by the community.&nbsp; The general objectives of the awards are to:<br /><br /></li><ul><li>give recognition to well-engineered municipal civil projects;</li><li>portray the art and science of municipal civil engineering to the general public; and&nbsp;</li><li>illustrate how the profession finds answers to challenging problems.</li></ul></ul><blockquote><p><strong><br />AWARD CRITERIA - </strong>Submitted projects ought to satisfy some or all of the following criteria and&nbsp; should:</p><ul><li>portray the art and science of municipal engineering to the general public and indicate how the profession finds answers to challenges;</li><li>be within southern Africa;</li><li>have current public interest;</li><li>demonstrate ingenuity through the solving of engineering or environmental problems in analysis, design or construction technique;</li><li>have aesthetic appeal;</li><li>display functional efficiency and economy;</li><li>illustrate unique or unusual features and demonstrate some notable advance in the solution of engineering problems;</li><li>have been well managed, finished on time and be largely within budget.<br /><br /></li></ul><p>Projects may be of any size and need not necessarily be complete in all aspects, but the major engineering aspects must be scheduled for finalization before the end of 2006. <br /><br /><strong>CATEGORIES - </strong>Projects may be entered into more than one of the following categories.&nbsp; One award will be made in each category:</p><ol><li><strong>NEW OR INNOVATIVE TECHNIQUES</strong></li><li><strong>WATER/WASTEWATER&nbsp;&nbsp;</strong></li><li><strong>ROADS/STORMWATER</strong></li><li><strong>ENVIRONMENTAL</strong></li><li><strong>COMMUNITY UPLIFTMENT </strong></li></ol><p>In addition to the above criteria, the submission of community-based projects should illustrate effective and successful co-operation between the engineer and the community served by the project and between other interested or affected parties (such as local authorities, non-governmental organizations and the labour force).&nbsp; In addition, both the natural and social environments should have been successfully addressed by the project.</p><p><strong>SUBMISSIONS -&nbsp;</strong></p><ul><li>The text should be typed on A4 paper and consist of between 1 500 and 4 000 words.</li><li>A comprehensive summary of the project (suitable for distribution to the media) must be included.</li><li>The main aims of the project, the approach to its design and justification for adopting the selected construction method must be covered.</li><li>A brief statement, if relevant, of any unusual features (e.g. unconventional calculations, particular specification requirements, etc) should be included.</li><li>There should be not less than two, and not more than, five colour photographs (250 x 200 mm) of the scheme. Award winners may be required to submit further photographs suitable for reproduction.</li><li>There must be written approval by the owner(s) of the scheme.</li><li>Submissions should preferably be made by all the principal parties concerned with the scheme (should only one party make the submission, it must be done with the support and approval of the other parties involved).</li><li>A map showing the location of the scheme or where elements may be viewed should be included.</li><li>Give the name(s) and contact details of knowledgeable party(ies) from whom further information could be obtained.</li><li>A completed official Entry Form must accompany the submission.</li></ul><p><strong><br />CONDITIONS -</strong></p><ul><li>The adjudicators reserve the right to elect local nominees in certain geographic regions who may visit the projects under review and report back to the adjudicators.</li><li>The adjudicators or their nominees must be allowed safe and reasonable access to all parts of the scheme submitted.</li><li>The adjudicators have the right to reject any submission for which the documentation does not comply with the stated requirements of submission or entry.</li><li>All material submitted becomes the property of IMESA/SAACE. </li><li>IMESA/SAACE reserves the right, without payment of fees or royalties, to make whatever use it may consider desirable of material submitted in connection with the entries, including the publication of photographs and names, and to select from the entries, at its own discretion, material for exhibition or publication, irrespective of the results of the awards.</li><li>The decision of the adjudicators shall be final and binding on all entrants.</li><li>Only schemes considered by the adjudicators to be sufficiently meritorious will be considered for this award.</li></ul><p><strong><br />ADJUDICATION - </strong>Entries will be judged by a nominated panel of qualified engineers, each an authority in his field, and under the chairmanship of the IMESA and SAACE Presidents. &nbsp;If there is no project of sufficient merit in any of the five categories, no award will be made for that particular category.&nbsp; <ul><li>As part of its responsibility to maintain a positive profile for members of the IBDS in organizations/entities that may result in work opportunities in the longer term, I regularly attend and participate in the activities of the <strong>Nepad Business Foundation (NBF)</strong>.&nbsp; The portion of the Mission of the NBF that&nbsp;is of particular interest to Consulting Engineers is the part&nbsp;that says &quot;the organisation will develop a body of interested and affected businesses, who have a common purpose, to identify and <strong>pursue multiple opportunities</strong> in Africa&quot; and the section mentioning &quot;to network, identify opportunities, disseminate information and <strong>ultimately bring projects to fruition</strong>.&quot;&nbsp; The foundation was slow in getting off the ground but it is now at that point where it is ready to produce results.&nbsp; A Section 21 company has been created.&nbsp; A full time CEO has been appointed and a matrix of projects to be pursued has been drafted.&nbsp; I am particulary interested&nbsp;in creating a situation where South African resources (including finance) could be used to execute some of the projects on the matrix. &nbsp;<br /><br />Under the leadership of Mr. Reuel Khoza I think the time has come for our industry to consider membership of the NBF.&nbsp; On the 22&nbsp;August 2006, at 15h00 in the afternoon at SAACE, the NBF will do a presentation on it&#39;s objectives to members of the construction industry.&nbsp; The booming local market provides an ideal platform over the next few years for companies to find news to participate in African projects.&nbsp; Please have a look at the <a href="http://www.nepadbusinessfoundation.org/">NBF</a> website should you require more information. <br /></li></ul><p>Should you have any queries, kindly contact Roelof van Tonder at (011) 463-2022 or email <a href="mailto:roelofvt@saace.co.za">roelofvt@saace.co.za</a>.<br /></p>
