<ul><li>As usual we're in a rush to complete the newsletter, but this time the reason is that we have to make our way to the golf course to be good hosts for the <strong><em>Annual Golf Day</em></strong>. This year we have had a huge response over last year with 144 players taking to the field at the Blue Valley Golf Estate in Midrand which is Gary Player designed and Malaysian owned. We now call it the "SAACE Presidential Golf Challenge" and one of our firms has donated a floating trophy for the overall winner. Our partners and other sponsors have given us incredible support for what looks like to be, apart from the weather, a great day for members and their clients. As they say - a bad day on the golf course is always better than a good day in the office. <br /><br /></li><li>Some good news - the business component of the <strong><em>Construction Industry Charter Group </em></strong>have agreed in principle to form a business caucus under what will be known as <strong><em>Construction South Africa</em></strong>. This will become the united front for our industry when dealing with issues such as the Charter, the non performance of the CETA, CIDB and procurement issues etc. We have also agreed in principle that this body would formally become a member of Business Unity South Africa (BUSA) which will enable us to debate and influence government policy through NEDLAC. There is a draft Constitution on the table and we are hoping to have a formal signing ceremony to launch CSA on Day 2 of our Construction Industry Conference which is to be held in Durban from 29<sup>th</sup> - 31<sup>st</sup> October 2006.<br /><br />On the subject of the Charter, the process is still on track, with the document currently lodged with the DTI for a Section 12 and a formal Section 9 approval. The CTCG has appointed a firm of attorneys to do the required independent third party review and they will also assist in finalising the Charter Council Constitution. The CIDB is making a significant financial contribution to fund this process. It is unlikely that the Charter will be gazetted until early 2007, however, the much awaited interim guidelines/circular encouraging members and clients to start using the Scorecard, even at this stage, is likely to be ready for issue within the next two weeks. It will be distributed to members through all the participating industry bodies as well as to clients. This Scorecard will serve as input to the tender evaluation process regarding BEE in terms of the PPPFA. Incidentally, we also anticipate the amended version of the PPPFA Regulations to be published within the next few weeks. This document will harmonise the requirements of the BBBEE and the PPPFA Acts on procurement issues.<br /><br /></li><li>Our thanks go out to all who participated in "<strong><em>Job Shadow Day"</em></strong>. We had a tremendous response and many many photographs depicting the events of the day. We have completed the adjudication process and the winning firm will be entitled to send a delegate to the Construction Conference at no charge. In addition, we will recognise that firm during the proceedings of our AGM on Tuesday, 31<sup>st</sup> October 2006, commencing at 11h00.<br /><br /></li><li>Our <strong><em>National Liaison Committee responsible for Treasury</em></strong> issues met with senior officials last week. We were told emphatically that Government is not going to amend its procurement requirements, however, they have explained that if the legislative requirements are correctly interpreted, they are far less onerous than currently perceived. What they will do, in partnership with industry bodies, is create a simplified Practice Manual setting out the process in terms of their norms and standards eg, if the client body advertises and sets up a Register of service providers in terms of specific criteria, it can then select from this register and call for quotes, tenders or expressions of interest from particular categories. It then does not have to advertise shotgun approach for each and every contract. Clients can request the Tenderer to supply a price (lump sum) or in terms of rates. I am not sure that this is going to solve the capacity issue amongst public sector clients and certainly we are still left with the problem of inadequate Scopes of Works which still needs to be dealt with.<br /><br /></li><li>Webster Ndodana and I are off to <em><strong>Mafikeng and Potchefstroom on the 30<sup>th</sup> and 31<sup>st</sup> August 2006 respectively</strong></em> for the final Presidential visit of the year. We are going to spend some time with the local authority in Mafikeng which it seems is going to be the next local authority that we support in terms of our partnership with DPLG. It looks like we are about to finally sign the Memorandum of Understanding with that Department and hopefully I can report as such in our next newsletter. We will call for an expression of interest from those firms willing to participate in supporting Mafikeng. <br /><br /></li><li>Please be aware - one of the <strong><em>many scams</em></strong> around involves a deposit in your account by persons purporting to purchase something, you then get a telephone call to say that the deposit has been made in error, could you please do an electronic refund (which is instantaneous), after which the initial deposit is negated through a cancellation of their cheque and you are left out of pocket. The SAACE has been hit twice in the past few weeks, but fortunately Tony Bradley is on the ball, and we were not affected. This same scam is now being carried out under the guise of SARS where the deposit is explained as an erroneous tax refund. Any transmittance by yourself is unrecoverable because, unlike a cheque which can be stopped, it is instantaneous.<br /><br /></li><li>Finally, I wish to make an appeal to all member firms to ensure that they use the <strong><em>SAACE logo on construction sites</em></strong> at the same time making sure that it is the latest logo - the one that has been in existence for the last 10 years! Remember it is all about branding and being visible. You may also wish to ensure that your letterheads incorporate the Association's logo..... we believe it adds value to your business. <br /><br /></li></ul><p><strong><em>Graham Pirie </em></strong> </p>

<ul><li><strong><em>Fraudulent CV's </em></strong>- A member firm asked me to warn all other member firms about the incidence of fraudulent CV's received from aspirant employees in the engineering field. In this specific case the candidate presented a very impressive CV, claiming that he was part of the design team on a specific major project. The only problem was that the firm offering the position he was applying for, was the same firm appointed to do the design on that project. The aspirant employee had never been on the design team as claimed in his CV. Needless to say, he didn't get the job. Other appropriate action was also taken. Therefore, in times when member firms are battling to appoint suitable engineering employees, make sure that prospective employees in fact have the experience they claim.<br /><br /></li><li><strong><em>Procurement - </em></strong>Recently a municipality interpreted "conflict of interest", as per Regulation 44 of the Municipal Supply Chain Management Regulations, to mean that if a firm has been appointed for a project, it cannot be appointed for another project by the same municipality until the first has been completed. The Treasury Guideline, "Supply Chain Management: A Guide for Accounting Officers of Municipalities and Municipal Entities", offers guidance in this regard. Under Clause 5.4 "Conflict of Interest", the whole issue is clarified. A Consultant's fiduciary duty, as representative of the client, is the basis of the requirement to avoid conflicts of his own corporate interests with that of the interests of the client. Examples of what might constitute a conflict of interest, are given:<br /><br /></li><ul><li>A Consultant cannot be appointed as Consultant for a project and also be the Contractor or Supplier for the same project unless it is a turnkey or design-and-build project. <br /></li><li>A Consultant appointed for the design on an infrastructure project cannot do the independent environmental assessment as well.<br /></li></ul></ul><blockquote><p>National Treasury was informed, and the necessary action was taken in order to correct the matter.</p></blockquote><ul><li><strong><em>CIDB</em></strong> - It has come to my attention that the new CIDB Regulations have been gazetted on the 18 August 2006.
