<p>We are now well and truly into the home straight - can't believe how quickly time has passed this year.</p><ul><li>Both <strong><em>SAFCEC</em></strong> and <em><strong>SAACE</strong></em> are putting the final touches to our Construction Conference which takes place the week after next at the ICC in Durban. It's looking good with 350 delegates registered so far to partake in a very worthwhile programme of events. Anybody still requiring details can receive same on our website, <a href="http://www.saace.co.za/">http://www.saace.co.za/</a>. Our AGM of course takes place the following day and we have received a number of requests for discussion under our usual item for "On a Point" relating to tendering, discounting etc, etc - no surprises here. <br /><br /></li><li>As you know we partnered with<strong> <em>IMESA</em></strong> at their Conference last week by assisting them with their Annual Awards. Webster Ndodana and their president, Tjaart van der Walt, recognised a number of local authorities for their projects together with the associated Consulting Engineers. It was a good start and <strong><em>SAACE</em></strong> was very visible but we need to improve on the format for <strong><em>IMESA</em></strong> 2007 to be held from the <strong><em>23 - 26 October at the ICC in Durban</em></strong>. A number of our member firms gave excellent presentations, but the one that really impressed me, was a paper by Merwyn King on Corporate Governance where he said it is not a compliance issue but a quality issue. He then went on to talk about the cost of compliance and the fact that no amount of legislation will make an impact unless we embrace the notion of honesty, integrity and make it part of our DNA. Judging by the many reports in the press, we all need to make a contribution to improving and enhancing corporate governance in South Africa. <br /><br /></li><li>Crunch time has arrived for the <strong><em>CETA</em></strong> - the forensic audit report has been presented at their Council and will be considered at a meeting of their Council on the 25 October. Our representative has made recommendations on the way ahead and some tough decisions will have to be made within our own <strong><em>EXCO </em></strong>on behalf of membership, as well as by our other built environment professional colleagues. We will keep you posted. <br /><br /></li><li><strong><em>The ECSA Fees Committee</em></strong> had their meeting on last Wednesday but I will leave it to Quentin to give you a detailed feedback in the next issue.<br /><br /></li><li>We also had an <strong><em>EXCO</em></strong> meeting this week and it was agreed to hold a <strong><em>Consulting Engineering Indaba/Workshop</em></strong> to discuss issues affecting our sector such as Supply Chain Management, the tender processes, Construction Charter issues and certain items affecting business behaviour in the negative sense, such as discounting. This has to be a very vigorous debate helping us to formulate hard and fast views on these matters which will inform our decision making and hopefully the way our members operate in the market place. We are drafting a Programme which will include key speakers from within our membership, our client bodies and hopefully get an international perspective on Procurement issues from the <strong><em>World Bank</em></strong>,<strong><em> the</em></strong> <strong><em>European Bank for Reconstruction and Development</em></strong> and the <strong><em>Canadian Association of</em></strong> <strong><em>Consulting Engineers</em></strong> who have sold the concept of <strong><em>Quality Based Selection</em></strong> to their public sector decision makers. We have set a date of the 13 February 2007 and it will be held at a venue close to <strong><em>O R Tambo International Airport</em></strong>. We will keep prices low to cover costs, and it would be appreciated if you made a note in your diary to attend. <br /><br /></li><li>We also agreed at <strong><em>EXCO </em></strong>that errant clients who put out poorly compiled requests for our services should be challenged which we have already started to do with a large measure of success. We are not in a position to tell our members not to tender, as this will be contrary to healthy competition, but what we will do in future is inform our members of any pitfalls that may arise in responding. SAACE will put out a Cautionary, but it will be up to our members to analyse risks and price accordingly. The Directorate is compiling a spreadsheet of such cases we have dealt with over the past year together with the success or failure we have had in ensuring clients use Best Practice Methods complying with the legislation. <br /><br /></li><li><div>Can't recall if I told you, but we have finally signed the <strong><em>Memorandum of</em></strong> <strong><em>Understanding (MOU) with the DPLG</em></strong> and just to keep you updated we have now partnered with them to support another local authority, this time <strong><em>Mafeking</em></strong> <strong><em>Local Council</em></strong> where <strong><em>Bigen Africa</em></strong> has been appointed to assist. We now have 5 local authorities in the programme with more to come. We will continue to call for Expressions of Interest as and when <strong><em>DPLG </em></strong>allocate a municipality and evaluate in terms of our criteria which includes the particular needs of the client. <br /><br /></div></li><li><div>I gave feedback on the <strong><em>FIDIC Conference</em></strong> last time around but would like to encourage you to visit the<strong><em> FIDIC</em></strong> website as there are a number of publications relevant to your business which you should know about, including new guidelines and contract documentation. Maybe I will get time in the next issue.<br /><br /></div></li><li><p>On 12 October 2006 <strong><em>BEPMEDS</em></strong> launched the benefit structures for 2007. Proceedings started with a welcome from the Chairman of the Board of Trustees, Mr Des Linder. The meeting was attended by members, brokers and trustees. The highlight with regards to benefits was the significant annual increase across a wide range of benefits, spread across all the benefit options, as well as a medical savings facility that was reintroduced into one of the options. <br /><br />During a recent discussion Mr Des Linder highlighted the fact that the scheme belongs to "us" and that fundamentally the scheme is managed by professionals, for<strong> </strong>professionals, focusing on our needs. I share his contention that CEO's have nothing to lose by instructing their brokers to do a comparison of BEPMEDS with their current and other schemes. CEO's must augment the opinions of brokers by directly talking to trustees to confirm the facts about the scheme. Some CEO's and their HR professionals have the wrong perception that BEPMEDS is too small and does not offer some of the popular "lifestyle benefits" that the bigger schemes offer. This is simply not true as BEPMEDS offers all those benefits and is financially stable. We are redoubling our efforts to promote the scheme, because it is one of the key benefits of membership of the Association, especially for smaller firms. Professionals in smaller firms do not have the time or the clout to solve problems when things go wrong. Conversely some of the larger firms, who belong to BEPMEDS, nominate their own trustees to the board and ensure in this way that the scheme is managed responsibly to the best possible benefit of its employees, and ultimately the firm. The recently appointed YPF trustee onto the board makes sure the product suits the needs of young professionals as well. </p></li></ul><p><strong><em>Graham Pirie</em></strong></p>

<ul><li><em><strong>CIDB -</strong></em>In a previous e-news edition, I informed you about the <strong><em>CIDB Inform</em></strong> <strong><em>Practice Notes</em></strong>. <strong><em>CIDB</em></strong> has now issued a new practice note, Practice Note 3. CIDB Inform Practice Notes provide guidance and clarity in achieving client objectives in procurement and delivery. They are aligned with, but do not replace regulation. They aim to inform clients and practitioners on how to effect best practice and deal with issues that may arise. <br /><br /><strong><em>Practice Note 3:</em></strong> "Applying the register of contractors in construction works contracts", identifies which contractors need to register, describes the categories of registration and the CIDB contractor grading designations and establishes a step by step procedure to satisfy the requirements of the <strong><em>Construction Industry Development Board Regulations</em></strong> (as amended up to 18 August 2006) in relation to quotations, tenders and expressions of interest. <br /><br />This practice note should be read in conjunction with the amended Regulations and the Standard for Uniformity in Construction Procurement. These can be found at: <a href="http://www.cidb.org.za/Regulations/CID_Regulations_as_amended_Aug_2006.pdff">http://www.cidb.org.za/Regulations/CID_Regulations_as_amended_Aug_2006.pdff </a>for the Regulations and <a href="http://www.cidb.org.za/Notices/Revised_SFU_20_August_2006.pdf">http://www.cidb.org.za/Notices/Revised_SFU_20_August_2006.pdf</a> for the Standard for Uniformity.<br /><br /></li><li><strong>SANS 10400- </strong>The <strong><em>SAICE Geotechnical Division</em></strong>, in response to a letter from the <strong><em>Technical Committee for Construction Standards</em></strong> responsible for the updating of SANS 10400 "The application of the <strong><em>National Building Regulations",</em></strong> declined the Technical Committee's invitation to make a submission to the <strong><em>National Dolomite Risk Management Working Committee.</em></strong> The <strong><em>SAICE Geotechnical Division</em></strong> stated that in their opinion role-players such as the SAICE Geotechnical Division and the South African Institute of Engineering and Environmental Geologists were more suited to advise the <strong><em>Technical Committee</em></strong> on matters pertaining to the definition of a <strong><em>"Competent</em></strong> <strong><em>Person (Dolomitic Areas),</em></strong> as defined in the draft version of the above SANS document, than the above mentioned national working committee pertaining to dolomites. In addition, the Geotechnical Division mentioned that there was no clarity on what mandate the National Dolomite Risk Management Working Committee had, pertaining specifically to advising the <strong><em>SANS 10400 Technical Committee. <br /><br /></em></strong>The SAICE Geotechnical Division further recommended that the concept of a competent person for work in dolomitic areas be abandoned and that instead the definition of a Competent Person (Geotechnical), as defined in SANS 10400 Part H, be adopted for all geotechnical related work, including work in dolomitic areas.<br /><br /></li><li><strong><em>Advisory note for the week- </em></strong><strong>Employment Equity Act (search code 99/2)<br /><br /></strong>The advisory notes on the SAACE website cover a wide field of topics, ranging from business practice to risk management. <p>I have been out of the office for a large part of the last two weeks due to another addition to my family so my contribution will be short. The most important event of the last two weeks, other than the arrival of my son, was the fact that we <strong><em>(DTI, SAACE)</em></strong> met with the <strong><em>International Finance Corporation</em></strong> to discuss the improved utilisation of Consulting Engineers among other things. One of the most important outcomes is the fact that a web based database of South African Suppliers (in our industry it will be limited to members of the IBDS) to the <strong>World Bank/IFC and African</strong> <strong><em>Development Bank</em></strong> will be created. <br /><br /><br />One of the primary tasks of the IBDS is to promote the South African Consulting Engineering industry as a preferred supplier with these institutions. While this was done in the past, the one thing that was lacking was a specific instrument that would allow officials from these institutions to identify suppliers from South Africa. We have had a specifically frustrating experience with the creation of the SA Consultants Trusts Funds in that they were not used because of the lack of a reliable instrument or method that Bank officials could follow in identifying reliable South African suppliers.</p><p>It is also important to note that steady progress is being made with the creation of an export council for the IBDS. The application has been submitted and the DTI indicated that they will fast track the application.
