It is intended to make it an easier and quicker read and best of all there will be no more attachments.

<ul>
<li>Many of the Association's members were recently the victim of a computer generated virus . As this problem is becoming more pervasive you too could become a victim and it is important to ensure that you have measures in place to adequately protect yourself. As you will be aware we were merely victims of the virus which attached itself to our newsletter. Through the assessment of computer logs, which are available for your perusal, we have traced the source of the virus to four member firms with whom we have communicated directly. At the time that the virus hit, our staff were overwhelmed with the call volumes and we did not have the capacity to deal with everyone on an individual basis but tried to keep everyone informed to the best of our ability through email notices and messages on the website. Patches for this virus are still available from us and will be sent to you, but on request. We have since discovered that SAFCEC and SAISC and their members were also badly affected. We have increased security for our on-line communications such as e-news in order to reduce the risk. We have had two independent audits of our systems to ensure that best practices are adhered to. While it is important to keep your antivirus software up to date and enabled it must be remembered that the purpose of a virus is to defeat those very systems. <br>

<li>Much of our time and capacity at the moment, especially mine, relates to satisfying the needs of DPLG in their endeavours to assist poorly capacitated local authorities with their service delivery . You will have seen a number of emails in this regard. The Association's role at this time is mainly to assist with the creation of a Special Purpose Vehicle (SPV) under a mandatory agreement from DPLG which would allocate resources from amongst our membership to predefined municipalities. The SPV would be ultimately a non-profit Section 21 company responsible for overall co-ordination and programme management. There is no space here to get into all the complexities and contractual issues but the important thing for us is to get projects flowing wherein all our members can benefit across the country. Thank you to those who have responded but I request your patience whilst we deal with logistical issues. <br>
<br>
<li>Recently I was invited by the Namibian Association of Consulting Engineers to give presentations to their clients and their members, but mainly from a GAMA perspective. There have been a number of tensions developing between South African companies operating in Namibia mainly because local partnerships or tenders are not sought. I was able to resolve a number of these issues and we have committed ourselves to work together in the interests of our collective industry. If you are working in that part of the world and have any problems please give me a call and I will try and assist in their resolution. <br>

<li>Our Council meeting took place on the 15 th February and just to mention some highlights: <br>

<li>We spoke to National Liaison Committee Convenors (NLC) and Branch Chairmen at a pre-council meeting to give them a sense of our �3-core� messages to clients and to appraise them of the marketing and client liaison material that we have prepared to assist in this interaction. Webster Ndodana's theme for the year is �Engineering and impact on service delivery through partnering� and in this context we are to concentrate on service delivery, capacity building and transformation as the main focus areas for 2006. Just to remind you, all reports for our liaison meetings are filed under the Member zone of our website and can be accessed on <a href="http://www.saace.co.za/producenlcmatrix.php4">www.saace.co.za/producenlcmatrix.php4 </a>. In addition all client bodies and their contact details as well as those of our NLC Convenors are available on the website. We use this database to communicate directly with our clients through Inside Track, Directory of Firms etc. Please help us in keeping it up to date and if you notice any errors please let us know.
<li>Another issue discussed in Council relates to difficulties which public sector bodies are having with the new Procurement legislation and particularly the process of tendering for professional services. We are assisting clients where we can and at the moment are interacting with CIDB, National Treasury, IMESA and Transport and Public Works in the Eastern Cape plus a few others.
<li>We got approval to proceed with our DPLG capacitation initiative, mentioned previously .
<li>We also recognised Dolf van Huyssteen for his considerable time devoted to the Association as NLC Convenor for the Roads Liaison Committee. </li>

<li>Just to remind you that the first Presidential visit by Webster and myself takes place on the 2 March with a visit to Cape Town followed by 14 March to Northern Cape and 15 March to the Free State . Each of these visits will be a joint SAICE/SAACE visit which should alleviate some of the pressure on your time. <br>

<li>Trevor Manual often laments that industry is not taking advantage of the government's commitment to public private partnerships. There are some very good courses offered by the PPP Unit of National Treasury (PPP's) . This includes foundation training and training for transaction advisors. The first is a 2-day Foundation Training course whilst the second is a 1-day Transaction Advisors course. There is no cost attached and all their material is issued free of charge. <li>The Construction Charter Group has finally agreed to once again holding a Construction Conference, this time at the ICC in Durban from 29th - 31st October 2006 . Please make a note of these dates as it will also include the SAACE's AGM. The group has also agreed to collective membership of Business Unity of SA (BUSA) . <br>
<br>
<li>Although the deadline for the return of Management Information Surveys (MIS) has passed I would appeal for you to nevertheless submit. Returns have been rather slow and erratic perhaps because of the email problem. The SAACE/Glenrand MIB Business Awards Pre-entry forms have been sent out with a return deadline set for 10 th March 2006. </li>

<li>The SAICE update of the GCC 2004, will include provisions relating to the current 1980 GCC for Electrical and Mechanical Engineering Works. A budget has specifically been allocated to address this issue. SAICE has also invited interested parties to submit possible amendments on the GCC 2004 document, to the secretary of the panel, Alain Jacquet, (fax 011-404-1728; email: <a href="mailto:ajacquet@ssinc.co.za">ajacquet@ssinc.co.za </a>), by 31 March 2006. In short there will ultimately be a single GCC for all electrical, mechanical and civil work.
<li>The CIDB has taken a decision to go ahead with the register of Professional Service Providers. Meetings to discuss the way forward will start soon.
<li>The Client/Consultant Professional Services Agreement, endorsed by SAPOA and developed over a number of years, is different to the CIDB Professional Services Provider document in that it focuses specifically on the client/consultant relationship, relating to construction projects. The CIDB document's focus is much wider. There is a need, however, to include such a document as a CIDB best practice document. A focus group will be created to do the necessary changes to the SAPOA document, in order to get it accepted by CIDB.
<li>It was also stated that the relationship of the consultant towards the client, has always been that of an agent toward his principal. This implies a trust relationship with the consultant having a duty of care toward the client. It was cautioned that this relationship should not be exchanged for that of a consultant being merely a contractor, furthering its own best interest. This would not be in the best interest of those clients who, due to a lack of capacity/skill, rely heavily on consultants to assist them in a number of issues relating to projects. Client/consultant agreements must be based on this duty of care. </li>

<li>After successfully completing the AfDB seminars, the International Business Development Section is now in the middle of pursuing the objectives set for the year 2006 - so there is not much to report since the newsletter of last week. <br>

<li>The most important feature of the 2006 objectives is the securing of funding for the creation of three export groupings so that members can be paid to pursue specific project opportunities for the benefit of the rest of IBDS members. Now, I know you are saying �what does this mean�? In short it means that you will be able to maintain a presence in African markets without having to use too much engineering capacity which is obviously tied up in the opportunities in the domestic market. The IBDS will make sure that its members are positioned to take exports up again once the inevitable downswing in the local market arrives! </li>
