many holidays and too much work to do. </p> </p> <ul> <li> A highlight though was a <strong><i>visit by FIDIC President, Jorge Diaz Padilla</i></strong>, who gave a presentation to the Chief Executive Officers of some of our member firms at the DBSA Monday before last. The presentation basically was a replication of that given at the GAMA Convention in Bagamoya in Tanzania. It was interesting though during the questions and answers session that FIDIC did not support the notion of fee scales and that most countries worldwide did not have fee scales. Our local debate continues, however, where we hope to formulate a position on guideline fee scales and tendering for professional services shortly with a view to taking up the matter, together with our BEP colleagues, with National Treasury. We have planned a caucus meeting to share our views with SAIA, ASAQS, IMESA and the CIDB. We do believe that the procurement system at present is adding a lot of friction to the procurement process especially insofar as local authorities are concerned. This needs to be addressed as a matter of urgency. We will give you detailed feedback following our meetings. <br><br> <li> We are also planning for the <strong><i>Associations Strategic Planning Session</i></strong> on the 9<SUP>th</SUP> May. The recent Perception Survey carried out by Pulse Research has now been received and will serve as input into this process so as to ensure that we remain in touch with views from our members, both large and small firms. Thank you to those who responded to the survey, the results are currently being analysed and will prove invaluable to the Association in its endeavour to remain relevant in the market place. We will in due course make a summarised version of the results known to all so that, as a collective, we can all play our part in making our organisation responsive to the needs of both members and clients alike. <br><br> <li> Some feedback on the <strong><i>DPLG initiative</i></strong> � we have now succeeded in allocating Implementation Agents in 3 of the 5 Local Authorities designated to form part of a pilot scheme. MVD Kalahari in association with C & V are assisting Tsantsabane (Postmasburg), Mzansi are to assist J S Maroka and Africon, Makhudutamaga. We are still to finalise Greater Kokstad and Cederberg and have been informed that the next local municipality to be added to the list is Mafikeng. The change to the current thinking is that instead of setting up a SPV Section 21 company to oversee the process, we are rather going to constitute a Committee of Council and hopefully our Council at their meeting on the 10<SUP>th</SUP> May will so resolve. We will also be using the CIDB standard Professional Services contract as a basis for the appointment between the local authority and the member firm designated to assist. Even though the member firm tried to convince the client not to do so, the client would not be swayed. The member firm approached the Association asking for information on the legal position in this regard.</li> <strong><i>Action taken by the Association</i></strong> - The member firm stated that they would negotiate further with the client once they were informed of the legal position. The following legal position was communicated to them and this was used to liaise with client.</p> <strong><i>Outcome</i></strong> - The municipal entity revised its Terms of Reference, but asked the member firm to take its previous reasons for requiring the use of the specific sub-consultant into account, when it drafted its proposal.</p> <strong><i>Legal position</i></strong> - The municipal entity is a company (Pty) Ltd, with the parent municipality as the sole shareholder.</p> National Treasury has released a guideline for Accounting Officers of Municipalities and Municipal entities pertaining to Supply Chain Management. This document states:</p> </p> <p style="color:#000000;font-family:Verdana, Arial, Helvetica, sans-serif;font-size:11px;line-height:14px;"><i>Clause 6 �Associations between Consultants� ��Accounting officers/authorities should not compel consultants to form associations with any specific firm or group of firms, but may encourage associations with the aim to enhance transfer of skills�.</i></p> </p> <p style="color:#000000;font-family:Verdana, Arial, Helvetica, sans-serif;font-size:11px;line-height:14px;">The following Act and Regulations are also pertinent:</p> </p> <p style="color:#000000;font-family:Verdana, Arial, Helvetica, sans-serif;font-size:11px;line-height:14px;">MFMA Regulations for Supply Chain Management (SCM): reg35(1) Any Treasury regulations must be taken into account when procuring Professional Service Providers (PSP). Therefore, the Treasury guideline above must be taken into account.</p> MFMA Regulations (SCM): reg11(1)(e) An SCM policy must provide for an effective system of acquisition management to ensure that Treasury�s guidelines are properly taken into account.</p> </p> <p style="color:#000000;font-family:Verdana, Arial, Helvetica, sans-serif;font-size:11px;line-height:14px;">MFMA Regulations (SCM): reg2(2) A parent municipality must ensure that its municipal entity�s procurement policy is consistent with that of the parent municipality. </p> </p> <p style="color:#000000;font-family:Verdana, Arial, Helvetica, sans-serif;font-size:11px;line-height:14px;"><strong><i>Summary</i></strong> - Although the guideline does not replace any legislation and should not be used for legal interpretations (see disclaimer in the guideline), and the regulations are not couched in obligatory terms, since the regulations merely say that the Treasury guidelines must be taken into account, a municipality or municipal entity will have to have very good reasons for not complying with the guidelines.</p> </ul> </p> <p style="color:#000000;font-family:Verdana, Arial, Helvetica, sans-serif;font-size:11px;line-height:14px;">If a parent municipality�s procurement policy does not differ from the guideline, then the procurement policy of its municipal entity, will have to be the same.</p> <ul> <li> The advisory notes on the SAACE website cover a wide field of topics, ranging from business practice to risk management. The reason for this is twofold; the DTI has waived the requirement that Councils must become self funding, and will continue its financial support. The IBDS can then access the funding from the DTI which will obviously directly benefit members of the DTI. The second reason is that being an Export Council will secure better access to other funds and decision makers in Government. While access is already very good, the experience with the Ma�aden project in Saudi Arabia has shown that it would be to the advantage of members.<br><br> <li> I have been participating in a Department of Foreign Affairs (DFA) led Conference on NEPAD in my capacity as an active member of the NEPAD Business Foundation. The purpose of the conference was to develop a more coherent South African response/strategy to NEPAD and its various projects. I was absolutely stunned to learn that the DFA has a R100 million (African Renaissance Fund) that could be accessed for NEPAD projects.
