<ul><li>The biggest event over the last two weeks has been the Association’s <strong><em>Strategic Planning Session</em></strong> held on the 9th May, the day before Council. The last such event was held early in 2002 so there really was a need for SAACE to take stock in the light of the many changes confronting the construction industry. The results of our Perception Survey also served as input which proved very illuminating. It is not possible to give much detail here but specific and detailed feedback will be given to all members and clients in the weeks ahead. In essence we concluded that what we are doing is correct and there was no fundamental paradigm shift in this regard. However, it is in the “how” that there needs to be fundamental changes which of course relates to the need for us to significantly upgrade the way we communicate with all stakeholders and enhance our level of visibility. The Perception Survey through the Quantitative and Qualitative analysis was incredibly valuable and I thank the respondents (27% of membership) for taking the trouble. We will listen and amend our strategies where necessary. Our overriding vision is to provide “value for money for members” and our priority areas in the year ahead relate to:<br /><br /></li><ul><li>building capacity amongst members and clients on issues relating to fees, tendering and procurement legislation</li><li>quality management systems and maintaining standards of professionalism </li><li>drive transformation and build partnerships with the public sector (DPLG initiative and the Construction Industry Charter) </li><li>assist in strengthening regional structures to be more effective at local level </li><li>provide visible discipline within our membership</li><li>engage key role players to enhance business interests and maximise income for member firms.<br /><br />There are other parallel initiatives which were identified but not viewed as top priority at the moment. It has also become obvious that the Association is trying to do too much and that there needs to be more focus. The specific Action Plans are currently being developed and fleshed out in order to present to EXCO on the 6th June.<br /></li></ul><li>At our Council meeting we ratified the outcomes of the Strategic Plan held on the previous day. We also reviewed our partnership with <strong><em>DPLG</em></strong> in supporting local government. We have created a dedicated “Committee of Council” to pursue this intervention and agreed the terms of reference. In essence it will provide the necessary oversight and set the rules of the game. Just to repeat what I have said in the past, we are directly involved in supporting the Makhudutamaga, Dr J S Maroko and Tsantsabane municipalities while we are still in the preparation stages for Greater Kokstad and Cederberg. We hope to conclude the Memorandum of Understanding (MOU) with DPLG next week and to finalise and agree the nature of contracts to be used with their KPA’s and performance elements. The SAACE will also deal with some of the inhibiting factors relating to procurement legislation. We have been rather slow and cautious in our approach because there is a need to ensure that the necessary paper work is in place to lower the risk between all parties. <br /></li><li>There was also a presentation to Council by Des Linder, Chairman of the Board of Trustees for <strong><em>BEPMEDS</em></strong> who gave us a status quo report. The scheme is looking good and the rates are more than competitive. SAACE President, Webster Ndodana, will shortly be writing to all members setting out the advantages of joining the BEPMEDS Medical Scheme. <br /></li><li>Many of you will be pleased to know that the <strong><em>Council for the Built Environment (CBE)</em></strong> has initiated an investigation into fee scales amongst Professional Service Providers working in the built environment. This is a wide ranging investigation currently being carried out by Stewart Scott International on their behalf. The terms of reference include looking at the benefits and disbenefits of the current approach to having guideline fees and the relationship between fees and salaries of professionals. The study benchmarks what we do in the international context. A preliminary presentation on the latest report was also given to our Council members. The SAACE Supply Chain Management Committee will be giving comments on your behalf, but any views are welcome to my office. <br /></li><li>I am sure you will all be interested to know that we have had three meetings of an all inclusive committee to request <strong><em>Treasury</em></strong> to review the procurement legislation in terms of “tendering”. These meetings have included SABTACO, SAIA, ASAQS, IMESA, CIDB and National Treasury who have been very cooperative. In essence the request is to request Treasury to streamline, simplify and review the criteria in regard to the tendering process to make it easier and less costly to apply. It goes without saying the present procurement legislation has become a major barrier to the delivery of services by public sector clients and in particular local authorities who in most instances do not have the capacity to comply. We are hoping that the R200 000 ceiling for competitive bidding be raised and perhaps the timeframe for roll-out be extended. A capacity building initiative should also be implemented to assist clients in understanding the requirements including how to compile terms of reference and scope of work so essential for a successful outcome. From our side, the Chairman of our Supply Chain Management Committee, Arthur Taute, the Chairman of our Transformation Committee, Francois Swart, and our Contractual Affairs Manager, Quentin Koen, have been the main players. Quentin will be giving you detailed feedback under his section from time to time.<br /></li><li>Some feedback on the <strong><em>Construction Charter</em></strong> – because the process has become rather protracted and the Scorecard cannot be implemented to the full extent prior to gazetting later in the year, the Construction Charter Transformation group has embarked on compiling a Client Information Sheet to assist firms and clients in developing a more equitable Procurement policy based on our scorecard. The proposed guideline is currently with senior Counsel to test the legality of issuing prior to the necessary legislation being in place.<br /></li><li>With a view to improving our communications, internally and externally, which has been highlighted as a need, the Directorate has completed an <strong><em>interactive marketing tool</em></strong> to assist Convenors and Branch Chairmen in their liaison (with clients) activities. It is very powerful and multi layered to the extent that it includes all one might require in supporting the liaison process eg the Charter, the Procurement legislation, SAACE’s reason for being etc, etc, etc. I am sure this will go a long way to assisting all involved. <ul><li><strong>Procurement</strong> - In a recent meeting with the National Department of Treasury, one of the issues raised was the fact that some local authorities have implemented procurement policies containing provisions that exclude certain categories of bidders on the basis of their BEE status. A Professional Service Provider (PSP) is scored in terms of his BEE status. The local authority uses some type of scorecard in this regard, the result of which is a percentage score indicating the bidding firm's BEE status. If the bidder’s BEE score is less that a certain threshold, as provided for in the procurement policy of that local authority, then it's bid will be regarded as non-responsive. When such local authorities are confronted in this regard they indicate that they are merely complying with the provisions of the BBBEE Act by promoting BEE. The Treasury representative clearly indicated that the practice of excluding certain categories of bidders, termed as a set-aside, is illegal. Treasury has issued two notices in this regard viz. MFMA circular no. 29 in terms of the Municipal Finance Management Act No. 56 of 2003, binding on local authorities, and Supply Chain Management Office Practice Note Number SCM 2 of 2006 pertaining to national and provincial departments, provincial treasuries, constitutional institutions and schedule 3A and 3C public entities. These documents can be downloaded from the Treasury website at <a href="http://www.treasury.gov.za/">www.treasury.gov.za</a> <br /><br />The Preferential Procurement Policy Framework Act (PPPFA) and its concomitant regulations, constitutes the framework in which all preferential procurement must take place (section 2(1) PPPFA). The PPPFA provides for two points systems, the 80/20 or 90/10 systems, depending on the value of the appointment. All points scored for BEE must be incorporated in the 20 or the 10 points above. The local authorities therefore have to convert the percentage score of a bidder, as mentioned above, to a score out of 10 or 20, and then apply the normal provisions of the PPPFA. Applying the scorecards outside this framework in the form of a set-aside, is illegal. <br /><br />Treasury is in the process of setting up an office of compliance to which all complaints regarding illegal set-asides etc can be addressed. <br /></li><li><strong>Advisory note for the week - </strong>Rendering Of Invoices And Recommended Action When Accounts Are Not Paid Timeously (search code 98/5). We have decided to show our commitment to the Department of Public Works by participating in this event by adopting what is called “Job Shadow Day", whereby children get the chance to answer the question, “why do I have to learn this? Students’ “shadow” workplace mentors as they go through a normal day on the job, The children see firsthand how the information they’ve learnt in school relate to the workplace. <br /><br />How we are going to do this? <br /><br /></li><ul><li>We will primarily be targeting pupils in their senior year at primary school and high school pupils.</li><li>Member firms are encouraged to choose schools from their local community and invite pupils from their chosen school to spend a day with them during National Construction Week experiencing 'A day in the life of a Consulting Engineer'. The idea of the Initiative is to encourage young pupils to choose “engineering" as a career. </li><li>We will be running a photographic competition among our member firms where they will be required to submit photographs of the day showing the student and teacher visiting a construction site. </li><li>The winner of the competition will be announced via the e-News and in Inside Track. </li><li>The Initiative will be promoted in the Engineering press both prior to and after National Construction Week. <br /><br />As members of the Association you are urged to participate in this initiative as it will encourage the pupils to choose construction as a career. <br /><br />For further information please contact contact Siphokazi Momoti on (011) 463-2022.</li></ul></ul>

We need to use this technology since this is the only way we can electronically match the participant, your answers and your ECSA number and electronically mark your test results. It is this that allows us to tell you within minutes whether or not you have earned your points! If we had to wait for you to fax your test, hire moderators to mark them and then you had to phone to get results, the cost would be much more than R3,00, the learner fees would need to be higher and it would take a lot more paperwork and time to get your results. <p>As you know from elsewhere in the e-news, the Association went through a Strategic Planning Session last week. During Council there was strong support for the IBDS to continue supporting its members in their International Business Development activities especially during this boom time in the economy. Council also supported the idea of creating an Export Council for Consulting Engineers as a means of ensuring the long term financial stability of the IBDS. </p><p>The IBDS also participated in a number of NEPAD Business Foundation (NBF) meetings. The following is a short summary of some of the issues discussed:</p><ul><li>The NBF hosted 3 infrastructure cross sectorial working group sessions. The purpose of these sessions was to identify and discuss the funding of NEPAD projects. The DRC-Angola infrastructure recovery programme was listed from an IBDS point of view. The NBF Board Meeting of the 19th May 2006 discussed a strategy regarding the implementation of these projects. Please call Roelof van Tonder for more information. <br /></li><li>The CEO of PM Global Infrastructure also did a presentation to the NBF Board on the NEPAD Infrastructure Investment Facility (NIIF). The firm is in the process of drafting a Business Plan for the NIIF and consulted with the various sectors of the NBF on what shape and structure the NIIF should take. The NIIF will be aimed at African enterprises involved in building, operating and investing in the region's infrastructure. Currently the envisaged objectives are:<br /><br /></li><ul><ul><li>advisory and transaction support</li><li>capacity building</li><li>seed financing</li><li>clearing house for information</li></ul></ul></ul><blockquote><p>What will separate this initiative from other similar initiatives is the fact that it will provide direct support to African firms involved in infrastructure.</p></blockquote><ul><li>Next week the IBDS will make a presentation to one of the largest construction firms (a member of the Bombela Consortium responsible for constructing the Gautrain) in the world on the IBDS and its members. The purpose of the presentation will be to discuss how this construction firm can employ the services of South African Consulting Engineers as part of the National Industrial Participation Countertrade Programme. While it is not sure what the value of the countertrade programme for Gautrain is, one can be sure that it will be substantial.</li></ul>
