<ul><li>Lets begin this week by giving you some feedback from our Executive Committee Meeting which took place on the 6<sup>th</sup> June 2006.<br /><br /></li><ul><li>As you know our <strong><em>Supply Chain Management (SCM) Committee</em></strong> has convened a number of caucus meetings with Stakeholders so as to engage with Treasury and the CIDB on the need to revisit the Procurement Policy in particular the matter of <strong><em>"tendering"</em></strong> for professional services. We all know that client bodies have a capacity problem and there is a need to perhaps lift the ceiling where tendering kicks in and also to possibly phase in the implementation of the Procurement Policy over a longer period. At the moment we hope to raise the threshold significantly to say R3mil (as opposed to R200 000 fee income). Treasury is listening and we hope to have some success. There is also a big debate on the need for fee scales, with widely divergent views prevailing within the BEP caucus. SAACE believes the guideline fee scales should be phased out over a period of say 5 years as this will hopefully eliminate the unhealthy practice of discounting and create a more sustainable business culture amongst professional service providers. The cost of doing work will then have to take centre stage.<br /><br /></li><li><p>Our <strong><em>Draft Strategic Plan 2006</em></strong> was approved in principle, the designated champions for the individual elements will each have to present detailed Action Plans for approval by EXCO on the 18<sup>th</sup> July and for final approval by Council on the 2<sup>nd</sup> August. Once finalised the Strategic Planning document will be forwarded to members for information and comment. </p></li><li><p>On the subject of the <strong><em>Construction Charter</em></strong> it has been proposed that a Procurement notice be sent to all clients giving notice of the proposed Construction Scorecard and encouraging them to incorporate the latter in their Procurement processes even at this early stage and prior to formal gazetting. Legal opinion on the proposed notice indicates that nothing stands in our way. This will ultimately be accompanied by a Procurement Road Show explaining to clients and members how everything fits together. SAFCEC has already embarked on such a Road Show and they have agreed to include Consulting Engineers in future presentations. Please see later on in this newsletter for details of these presentations which are WELL WORTH ATTENDING. An issue has arisen where it seems the DTI Generic Charter favours SMME's to a greater extent than the Construction Industry Charter ..... this will have to be addressed shortly. The latest version of the Construction Industry Charter, Version 6, resides on <a href="http://www.saace.co.za/">http://www.saace.co.za</a>. </p></li><li><p>We have been told that the <strong><em>CIDB</em></strong> has approved the compilation of a <strong><em>Consultants Register</em></strong> which SAACE fully supports. In effect this would mean a single national register for the entire country and not many hundreds of differing such registers amongst our public sector client bodies which will make life much easier for firms.</p></li><li><p>Planning has well advanced for both our <strong><em>SAACE Glenrand MIB Business Excellence Awards and the Construction Industry Conference.</em></strong> The former takes place at the Sandton Sun on the 2<sup>nd</sup> August and the latter from 29<sup>th</sup> to 31<sup>st</sup> October in Durban at the ICC. The Young Engineer Award this year is sponsored by SEW Eurodrive which will enable the successful applicant to attend FIDIC in Budapest during October.</p></li><li><p>Feedback from the <strong><em>Pulse Marketing Perception Survey</em></strong> criticised the SAACE for being a "toothless tiger" when it comes to disciplinary matters. The Disciplinary Committee will be re examining the whole process including the need for visible discipline. This has been included in our Strategic Plan.</p></li><li><p>The Association regards the <strong><em>Young Professional Forum</em></strong> as a very important initiative and in order to ensure that it does not lose momentum a Workshop has been convened for mid July to have another look at their reason for being. At present they are involved in developing an exchange programme for young Engineers between RSA and Mozambique as well as participating in NDPW Construction Week through an initiative entitled "Job Shadow Day"involving taking school leavers to the office for a day. This will be happening during the week 27<sup>th</sup> July to the 3<sup>rd</sup> August 2006. Log onto <a href="http://www.ncw06.org.za/">http://www.ncw06.org.za/</a>.</p></li><li><p>In terms of the new SAACE Constitution all member firms are required to install and maintain a <strong><em>Quality Management System </em></strong>by the end of June of this year. The Association appreciates some of the difficulties in adhering to this requirement and continues to give support, particularly to the smaller firms. We have agreed to extend the roll out for this requirement to the end of 2006. A letter will be sent to Mandated Principals shortly in this regard. It is also the intention of the Association to indicate Quality Management Management status for all firms in the 2007 Directory of Firms as well as on the electronic version situated on the website.</p></li></ul><li><p>I attended a <strong><em>DTI Strategy Session on Industrial and Trade Policy</em></strong> which was fascinating. It was convened by NEDLAC with participation from organised labour, government and business. The contents of these policy documents are very supportive of our industry and there is a lot of good news contained therein. We also need to ensure that the proposals inform our own Strategic Plan and vice versa. Both ASGISA and JIPSA require our commitment and involvement and form the basis of these policy documents. Copies can be obtained on request from Jean Stanford.</p></li><li><p>It is surprising that after 10 years some members <strong><em>are still using the old logo</em></strong> and referring to themselves as individual members of SAACE. This is a special request for you to please use the latest SAACE logo on your correspondence, on construction notice boards and perhaps even on your business cards.</p></li><li><p>The SAACE maintains <strong><em>a list of Retired Members willing to undertake work</em></strong>. I have many requests from firms asking whether they can have access to active retired members. This list is available and can be obtained from Jean Newman. This might come in particularly handy for those firms offering to assist with capacity building initiatives in local authorities or who require support in installing a Quality Management System. <ul><li><strong><em>ECSA fees </em></strong>-A guideline of disbursements for miscellaneous expenses has been prepared by ECSA in collaboration with the Association and Client-bodies, and can be viewed on their website <a href="http://www.ecsa.co.za/">http://www.ecsa.co.za/</a> under Consulting Fees. This guideline is not prescriptive and has not been published in the Government Gazette.<br /><br /></li><li><strong><em>Procurement Policies - Organs of State - </em></strong>We all know that organs of state, as defined in the PPPFA have to comply with the prescripts of that act, but what happens when a client has a 59% private share and 41% public i.e. when a municipality and a private organization create a body to perform a public function in terms of any legislation?<br /><br />After recent discussions with National Treasury pertaining to a similar case, the following applies:-<br /><br /></li><ul><li>Section 217(3) of the SA Constitution, has been amended by the Constitution of the RSA Second Amendment Act (Act 61 of 2001). Organs of State, as defined in the Constitution, now <u>must</u> use the framework as set out in the PPPFA when they choose to make use of a preference system to do procurement.<br /><br />Organs of State are defined much more widely in the SA Constitution than in the PPPFA, and include any functionary or institution performing a public function in terms of any legislation (Constitution of SA section 239(b)(ii)). This means that the client mentioned above will have to make use of the framework in the PPPFA if it chooses to incorporate any form of preference in its procurement policy, no matter that it is predominantly privately owned.<br /></li></ul><li><em><strong>Advisory note for the week </strong></em>- <strong>How To Prepare Effective Tax Invoices And Statements Of Account (search code 92/3).<br /><br /></strong>The Advisory Notes on the SAACE website cover a wide field of topics, ranging from business practice to risk management. <ul><li>A lunch meeting with <strong><em>SAACE Partners and Sponsors</em></strong> has been organized for Monday, 19<sup>th</sup> June 2006. The purpose of this meeting is for the Association to build and further cement relationships with our Partners and Sponsors.<br /><br /></li><li> <strong><em>Construction Week 27 July - 03 August, 2006 </em>- </strong>It was decided that YPF should run with this initiative under the guidance of SAACE reason being this initiative as this undoubtedly ties in with the YPF primary objective of bringing awareness to youth about Engineering as a profession. Sugan Naicker is YPF contact and he has already sent out an e-mail to Branch Chairs inviting them to assist in championing this effort in their respective regions. By way of explanation, bear in mind that the Voluntary Associations have been tasked by ECSA to deliver suitable CPD earning opportunities and the Association (SAACE) has contracted LLLS to bring you ECTV as an opportunity. ECSA will merely review your CPD portfolio and determine whether you have satisfied the requirements or not and will then either renew your registration or de-register you. <br /><br /><a href="http://www.ceta.org.za/" title="http://www.ceta.org.za"><strong>Construction Education and Training Authority</strong></a><strong> </strong><strong>-</strong> SAACE did not receive any written complaints regarding the problem areas when operating the CETA software package - filemaker - and therefore the deadline dates to submit WSP's and Implementation plans will not be extended.<br /><br /><strong>Young Professionals Forum</strong><strong> </strong><strong>-</strong> The YP's will get together at the SAACE offices on the 10<sup>th</sup> July to discuss strategies for the future, feel free to pose your ideas and make recommendations to them. <br /><strong><br />HR Forum</strong> - Please feel free to join us in the next HR meeting on the 26<sup>th</sup> of June at 10:00 (SAACE). We will address the YPF survey, recruitment issues, CETA and SACPCMP.<br /><br /><strong>Hot site for the week</strong> - Need help and some training on Microsoft Office, then go to: <a href="http://office.microsoft.com/en-gb/default.aspx">http://office.microsoft.com/en-gb/default.aspx</a>.<br /><br /><strong>QMS</strong> - SAACE Council approved a minimum standard for sole practitioners and the guideline document will be made available before the end of June 2006. The IBDS just went through a very hectic two weeks. Firstly a small delegation went on a very interesting and successful <strong><em>visit to the World Bank and the International Finance Corporation (IFC) in Washington DC.</em></strong> The visit was a success in that member firms had a programme of 25 appointments to choose from over four days and met with approximately 60 people from the World Bank, IFC and the local business community. The latter was an interesting addition the programme which gave members the opportunity to link up with local businesses that work in Africa and with the Bank. The support that we got from our Embassy in Washington DC was superb. While receptions are not that important, the fact that one was held for the delegation and Bank Officials provided an ideal opportunity to raise the profile of the delegation, especially since our Ambassador to the United States also attended the function. <br /><br />With regard to our interaction with the Bank it was interesting to see that one of the Directors of the Bank in charge of their Africa Action Plan opened his presentation with the following quote from the Economist; "<strong>"Africa - Whatever you thought think again" A Continent on the Move. </strong>The gist of his message in this regard is that Africa is growing and improving in a way that it did not just a few short years ago. The Bank is responding by substantially increasing its lending especially in the area of infrastructure. This was one of the key parts of his presentation, and dealt with the fact that over the last number of years Bank lending related to "Closing the Infrastructure Gap" increased <strong>threefold, </strong>and this growth is expected to continue. Spending on Regional Integration projects has also increased threefold. According to the Bank, demand for suppliers of goods and services to implement regional programs, substantially outstrips resources available and this is a huge business opportunity for South African Consulting Engineers and Contractors. The secret to tapping into these opportunities? Well the Bank is continuing with its decentralization programme with more decision making power being devolved to County Managers. This makes continued and active engagement of your potential clients in the countries concerned even more important. While visiting HQ in Washington DC every once in a while is essential, it is more important that you regularly visit your clients.<br /><br />What was also interesting to see was the Procurement Stats of South African Services Providers to the Bank. There is only a small group of about 10 South African Consulting Engineering firms that consistently do work for the Bank. The underlying message from many in the Bank is that they want to use South Africans and that our firms can, and should do a lot better. In the overall procurement stats, as can be expected, our services procurement performance is erratic with an income (@ R 6.5 to the Dollar) of about R 137 million in 2005 and R 43 million in 2004. Our best client countries are dominated by Anglophone countries in Southern and Eastern Africa including a lot of work generated in Madagascar.
