<ul><li>Another milestone for 2006 has been achieved with the holding of, by all accounts, a very successful <strong><em>SAACE Glenrand MIB Business Excellence Awards</em></strong> function. This year we had the very able assistance of our new Marketing and Events Manager, Siphokazi Momoti. To read more, go to "From the Marketing Desk" and please make a note in your diaries to prepare your entries for the 2007 event. We need to make our industry more visible and your participation does just that. As was the case this year we will position this function to take place during National Construction Week.<br /><br /></li><li>Also last week we had our quarterly <strong><em>Council</em></strong> meeting where we agreed the following:-<br /><br /></li><ul><li>We have set in motion a process to convert the present one year <strong><em>presidential term</em></strong> to an (optional) two-year term. The object of this change is to provide more continuity of office. This change will be referred to the AGM and subsequently put to ballot amongst the membership. If approved, the two-year term will commence at the 2008 AGM. The position of Vice President will be dispensed with. It was reaffirmed that Cecil Rose will take office as President for the 2006/7 term whilst Felix Fongoqa will become Deputy President.<br /></li><li>We also updated and progressed further with the various elements of our <em><strong>Strategic Plan - </strong></em>a more comprehensive communication on this at a later stage. <br /></li><li>The reference in our <em><strong>Code of Conduct, Item 9.11.2</strong></em>, regarding "<strong><em>irresponsible fee competition</em></strong>" was debated and will be discussed further at our next EXCO meeting. This needs a fresh look in view of the requirements of the Competitions Act balanced against the need to create a sustainable business mindset in the market place.<br /></li><li>The <strong><em>Financial Statements</em></strong> were approved for submission to the AGM which recommended a 4½ percent increase in subscriptions as well as an abolition of the fee for retired members.<br /><br /></li></ul><li>The most important item, in my view, coming out of the <strong><em>Quality and Risk Committee meeting</em></strong> yesterday was that although the PI Scheme is very healthy there has been a recent increase in smaller claims related to structural and geotechnical work. This is not surprising and was anticipated with the upturn in the economy and industry capacity being hard pressed to deliver. It is also interesting to note that in regard to these two activities, ECSA has also experienced an upturn in complaints from clients and members of the public. Please see this as an alert from the Association. At our annual meeting with the Insurers in December, we have given notice that we will be examining, with a critical eye, any increases proposed by the Insurers but this will be done in the knowledge that there is a claim cycle which is in sync with the prevailing economic climate. A sellers market seems to be the forerunner of an increase in claims and complaints. <br /><br /></li><li>A <strong><em>Construction Charter Working Group</em></strong> yesterday finalised a Procurement Notice to members and clients encouraging all to move towards what will inevitably become the Construction Charter and Scorecard. The parties to the Construction Charter Transformation Group see this as necessary in order to bring some sense to the still chaotic procurement environment with each client requesting different BBBEE evaluation processes. We hope to send this out within the next few weeks. It is still envisaged that our Charter will only be gazetted early in 2007, however, we have been informed that the DTI generic will be gazetted shortly.<br /><br /></li><li>We have now concluded our <strong><em>Presidential visits to Polokwane and Nelspruit</em></strong>. We had a particularly fruitful, although difficult, meeting with the Limpopo Roads Agency where we were informed that our members, in general produce poor estimates, embark on fronting and have links to Contractors which impact on their ability to provide independent advice to clients. In addition, as-built drawings were either not forthcoming or were of a poor quality. In short the client was not entirely happy with industry performance and was not afraid to say so. We should listen and act accordingly. The Association undertook to deal with specific complaints in terms of our Code of Conduct.<br /><br />Our last and final visit for the year takes place to <em><strong>Mafikeng on the 30<sup>th</sup> August and Potchefstroom on the 31<sup>st</sup></strong></em>. Notices have been sent our by the Branch Chairman, Mr Eddie Otte, but if you have not received an invite please do not hesitate to contact either this office or the Branch. <br /><br /></li><li>Last and certainly not least, we have a <strong><em>new Receptionist, Nthabiseng (Glenda) Tshabalala</em></strong>, who started on the 1<sup>st</sup> August. <ul><li><strong><em>Procurement - </em></strong>Complaints have been received regarding tender documents as provided by a coastal local municipality situated next to the City of Cape Town. The municipality placed six tender notices in the Cape Times.The Association will engage with this municipality on the matter, and request that these tenders be recalled, redrafted to comply with the CIDB standards, and thereafter to re-advertise. <ul><li><strong><em>SAACE GLENRAND MIB Aw</em>ards</strong> - A night to remember... as promised in our previous newsletter, this year's event was awesome and from the feedback that we‘ve received it was indeed a wonderful event. Copies of additional Certificates won by participating members will be sent to them shortly together with the CD containing pictures of the Awards. The CD is available on request, of course at a cost to members who did not attend the function. <br /><br />Next year's invitation to member firms to participate in this prestigious event will be sent out as early as December 2006. Member firms are urged to participate in all categories. It was somehow embarrassing to the Association to have received minimal entries for this year's Excellence Awards, especially in the Young Company and Young Engineer of the Year Categories. In next year's Engineering Excellence Awards, member firms are urged to participate by submitting entries in each and every category in order to keep the momentum of these awards.<br /><br />The Association wishes to congratulate all the winners for the effort they took in submitting the required material to make the event possible. The Association also wishes to extend it's gratitude to Glenrand MIB, it's key sponsor, for making the event such an incredible success.<br /><br />Thanks also to SEW Eurodrive for their contribution which enables the winner of the Young Engineer of the Year Award to attend the FIDIC Conference in Budapest. <br /><br /></li><li><strong><em>Construction Week, 27 July - 02 August 2006</em> </strong>- Incredible pictures depicting "Job Shadow Day" have been received from participating firms. The YPF adjudication panel will be sitting on the 15<sup>th</sup> August 2006 and the results will be announced on the 21<sup>st</sup> August 2006.<br /><br /></li><li><strong><em>1<sup>st</sup> September 2006 is World Casual Day</em> - </strong>Casual Day is a fundraising project for persons with disabilities. The SAACE has partnered with IMESA for what is now the SAACE-IMESA Annual Excellence Awards. <br /><br /></li><li><strong><em>Construction Conference</em></strong> - This year's Construction Conference will be in Durban at the International Convention Centre from the 29 - 31 October 2006. This year's theme is "Uniting the Construction Industry for accelerated Growth, Development and Transformation". The newly appointed Minister of Public Works, Thoko Didiza, will give a key note address on the 30<sup>th</sup>. <ul><li><strong><em>ECSA</em> - </strong>IDoEW, the latest document of interest to members is the draft document on the "thinking behind the proposals for the identification of engineering work for persons registered in terms of the Engineering Professions Act". <ul><li>In this week's contribution to e-news I would like to draw your attention to two important strategic developments in which the IBDS is involved in and which will impact on your international activities in the region (SADC). The first is the fact that the <strong><em>Trade and Industry Department</em></strong> is completing a number of sector-specific programmes, dubbed the Customised Sectoral Programmes (CSP), which aim to assist industries with growth and employment creation potential, in an attempt to boost downstream manufacturing and ultimately economic growth. Our industry is part of the Capital Equipment and Allied Services CSP and I have lobbied with the DTI to include a number of interventions of benefit to our industry. In the Business Day of 10/8/06 criticism was levelled at some CSP's such as the one dealing with the Motor Industry Development Plan and the Textile sector suggesting that they are ailing industries and that one should rather focus on competitiveness issues. While it would be unethical to share some of the details with you at this stage, my proposals to our CSP is related to improving our competitiveness in the region through the upgrading of our infrastructure linking South African markets to countries in SADC. What does this mean for YOUR business opportunities in the region? Well, if the CSP is approved I am confident that interventions that I have supported will specifically help Consulting Engineers to easier access South African finances to execute work in the region. Once published, I will be sure to inform members of the IBDS of these developments.<br /><br />The second issue that members should take note of is the fact that the FIDIC <strong><em>Task Force on GAMA</em></strong> is progressing well with it's activities, and it is very interesting to note the very high level of support and activity by members of our international parent body. The IBDS, through our CEO, Graham Pirie has been contributing and participating in the generation of Policy in this Task Force. Again, you may ask what is the impact on firms' business activities in the region? To me this is confirmation that the large Consulting Engineering firms based in developed countries see Africa, including South Africa, as a critical market in the future. My reports distributed to members of the IBDS regarding planned World Bank spending (in what they called their Africa Action Plan) confirms the importance of Africa as a strong growing market for Consulting Engineers. FIDIC and it's developed country members have recognised that capacitating GAMA and it's member firms is the best way to ensure future access to this lucrative market. <p>The long awaited Environmental Impact Assessment (EIA) regulations under the National Environmental Management Act No 107 of 1998 (NEMA) were promulgated on 21 April 2006 and became effective from 18 July 2006.<br /><br /><strong>Significant changes in legislation</strong> - We wish to draw your attention to some important features of this new legal framework, which is likely to impinge on most civil engineering projects. The new regulations differ from those they replace in several ways. Some of the more significant changes are as follows:-</p><ol><li>There are two lists of activities which trigger two different levels of assessment, namely<br /><br />a. Basic assessment - this applies to smaller projects where impacts are <br /> generally known and can be managed<br />b. Scoping and EIA - this applies to activities that due to their nature and/or<br /> extent are likely to have a higher risk and significant impacts which cannot<br /> be easily predicted or managed<br /><br /></li><li>The activities are more specific and are defined by thresholds above which the activity triggers a specified authorisation process. </li><li>Exemptions are specifically catered for under certain conditions. </li><li>Environmental Management Frameworks (EMFs) are introduced as a strategic tool for environmental management. The contents and structure of EMFs are defined.</li><li>Class applications are provided for.</li><li>The environmental authorities have been given review and decision-making timeframes which they are required to "strive" towards. </li><li>Appointment of an independent and competent Environmental Assessment Practitioner (EAP) is required for all applications. </li><li>The rights and obligations of those participating in a public consultation process have been more clearly defined. </li><li>The contents of the required reporting has been more strictly defined and Site Environmental Management Plans are incorporated into the reporting process prior to the decision. </li><li>The appeal process has been clarified and includes various iterations. </li><li>There is specific provision for the amendment of the conditions of authorisation after approval under certain circumstances.</li></ol><p><strong>Way Forward</strong> - We encourage you to review the new regulations at your convenience to obtain more detail regarding the nature of the listed activities and any other information you require.
