<ul><li>Apologies for lack of feedback from my side over the last couple of weeks but as you will see below it has been a bit hectic.&nbsp;&nbsp; Perhaps the best place to start is to give you some feedback from the <strong><em>Council </em></strong>meeting of 9 May.&nbsp;<br /><br /></li><ul><li>There was a much discussion about <strong><em>clients, either wilfully or otherwise, putting out poorly compiled tenders</em></strong> often in conflict with procurement legislation.&nbsp; Council indicated, in no uncertain terms, that we must become more aggressive and challenge these instances.&nbsp; A big thanks to members who report violations and although Quentin is taking a bit of strain, we are achieving results.&nbsp;&nbsp;In regard to the Coega Development Corporation (CDC) a big thanks to our members who stood together and did not submit tenders when called to do so by SAACE.&nbsp; In this instance a tender was withdrawn and re-issued shortly thereafter in violation of our Code of Conduct as well as contrary to&nbsp; legislative requirements. &nbsp;However, in a similar issue concerning Motlasana Municipality, members did tender ignoring our request not to do so.&nbsp;&nbsp;We will now have to decide how to deal with the matter in terms of our disciplinary process.&nbsp; We have been informed by National Treasury that they are in communication with the Matlosana Municipality regarding their poorly constructed call for tenders and process. &nbsp;The only way we are going to change the situation is for members to stand together and not accept what clients throw at us.&nbsp; Lets support the good clients and challenge the bad ones with vigour.&nbsp;&nbsp;<br /><br /></li><li>We have also been given the job of <strong><em>challenging the SACPCMP requirement for registration</em></strong> where only the last three years of relevant experience&nbsp;is taken into account in the registration process.&nbsp; We will do so at their next meeting with Voluntary Associations.&nbsp;<br /><br /></li><li>So far in our analysis of the Annual Declarations, some <strong><em>187 members of our full 470 membership base are not fully QMS compliant as required by our Code of Conduct.</em></strong>QMS is what differentiates us&nbsp;in the market place from the &quot;run of the mill&quot; and &quot;fly by nights&quot;.We will be communicating individually with each member firm with a view to offering assistance, but at the same time draw attention to their non-compliance and explain the way forward.In short, those firms that continue to be non-responsive could face future suspension and finally the Association would have no choice but to relieve them of their membership.&nbsp; In addition, we will be indicating&nbsp;member QMS status on both the website and in the&nbsp;future our hard copy directory.&nbsp; The Association is also in discussion with our Insurers to try and get some recognition for our member firms who are QMS compliant and some form of additional recognition for final ISO certification.&nbsp; Please remember that the firm is NOT required to be ISO certified, but merely to indicate that they have an ISO based QMS system in place.&nbsp; Remember, quality management and risk management are two sides of the same coin.&nbsp; On that note let me also mention that we are shortly to publish our &quot;how to&quot; <strong>Risk Management Guideline.</strong>&nbsp; One complimentary copy will be issued to each office of a firm&nbsp;whereafter the Guideline&nbsp;will be offered for sale at a nominal fee. &nbsp;Each firm will be encouraged to go through the process indicated in the manual and give us feedback on the efficacy thereof.<br />&nbsp;</li><li>The <strong><em>YPF</em></strong> have put together a very good Business Plan which has been accepted in principal by Council, but there are certain issues that need to be discussed further relating to finance, the website and the database.&nbsp;&nbsp; They are certainly to be congratulated on pinpointing the issues in our industry where they in particular can make a difference and further the aims and objectives of the SAACE brand.&nbsp; <br /><br /></li></ul><li>Whilst on Committees, lets look at our <strong><em>EXCO</em></strong> meeting held on the 29th May.&nbsp; The EXCO agreed that Council&#39;s recommendation to pursue the feasibility of setting up a <strong><em>Section 21 Special Purpose Vehicle (SPV)</em></strong> to deal with Government&#39;s increasing request to assist in their capacity building and accelerated delivery programmes.&nbsp; This SPV would ultimately handle our municipal support programme as set out in the MOU with DPLG as well as act as Implementation Agent,&nbsp;in terms of a request from DWAF.&nbsp;&nbsp; In addition, the DPLG Disaster Management Support Programme, which is shortly to be captured in another MOU would become the responsibility of the SPV.&nbsp; This SPV will not compete with members, but merely facilitate and devolve work to firms who in the process, will unlock projects and accelerate delivery of the respective infrastructure programmes.&nbsp; In order to increase the Directorate&#39;s performance in this area we are going to contract-in some support from our member firms to initiate the SPV and its proposed functions as well as employ an additional member of staff who will handle aspects of this work.&nbsp; This new appointee has as a KPA the improvement of our client liaison performance and will also provide support to the branches. The latter appointment will happen in August/September of this year.&nbsp;<br /><br /></li><li>The Association has now also adopted the <strong><em>Moretelle Municipality</em></strong> as the sixth local authority to be supported by one of the Association&#39;s members.&nbsp; In this instance it is MVD Kalahari through its Pretoria office.&nbsp; Past President, Webster Ndodana and Ivisited them on&nbsp;22nd&nbsp;May&nbsp;and met with the councillors and senior officials to determine their needs and to introduce the selected firm.&nbsp;&nbsp; <br /><br />We are also planning to have a workshop with our Implementation Agents who provide support to the 6 municipalities on the 27<sup>th</sup> June to share our experiences and to adopt a standard method of feedback on performance.&nbsp;&nbsp;&nbsp; Webster and I will also be attending a meeting between DPLG and the Executive Mayors of all municipalities on the 7 June 2007 in Cape Town to explain the nature of our support programme. <br /><br /></li><li>Indications are that <strong><em>National Treasury</em></strong> in redrafting the PPPFA&#39;s and Regulations are still ignoring our request to include &quot;Quality&quot; in the Procurement Process.&nbsp; We are endeavouring to interact at a high level emphasising that professional services have a quality component in the procurement evaluation process in addition to the existing price and BEE requirement. &nbsp;Incidentally, we will hold our long delayed <strong><em>Procurement Indaba sometime in February 2008</em></strong> whether or not the dust has settled on the legislative process. <br /><br /></li><li>It seems that the&nbsp;<strong><em>third</em></strong> <strong><em>party evaluation on our Construction Industry Charter</em></strong> will be completed by mid June and at the same time the Charter Council Constitution has been drafted.<br /><br /></li><li>We are aware of the problems that firms are having with the <strong><em>CETA</em></strong> in registering their WSP&#39;s.&nbsp;&nbsp; Please be assured that we have taken it up with the CETA through our Council member.&nbsp; Although the results have not been terribly satisfactory we will continue to elevate the&nbsp;debate to a higher authority until we eventually get some satisfaction.&nbsp;&nbsp; The deadline for WSP registration remains at 30 June 2007.&nbsp;&nbsp; Please forward any complaints you have to us for onward transmission to the CETA.<br /><br /></li><li><strong><em>Construction South Africa had its Council meeting on Thursday</em></strong> and considered reports from the various task groups relating to the CIDB-NHBRC, Macro economics, Sustainability, NEPAD and CETA - perhaps more feedback at a later stage. <br /><br /></li><li>In a meeting between the <strong><em>International&nbsp;Business Development Section (IBDS)</em></strong> and the DTI they re-affirmed their commitment to elevating the status of our IBDS Section to that of an Export Council which allows subvention on a rand for rand basis.&nbsp; This will allow us to increase capacity of the IBDS and make it even more effective.<br /><br /></li><li>Friday sees the <strong><em>bi-annual meeting between the Minister of Public Works and stakeholders to the CIDB</em></strong>.&nbsp; Again feedback at a later stage, but to let you know that the debate on the Consultants Register continues and that there will be a focus group meeting on that very same issue on the 26th June.<br /><br /></li><li>Finally, we had a very successful <strong><em>GAMA Conference and AGM in Gaborone</em></strong>.&nbsp; I will give detailed feedback through our news releases and Inside Track.&nbsp;&nbsp; The important thing is GAMA has definitely changed gears and moving towards becoming a more relevant voice for Consulting Engineers on the continent.&nbsp;&nbsp; The GAMA has a new Constitution modelled on that of FIDIC and has selected a new EXCO whose term of office is now 4 years.&nbsp; Representatives on the EXCO come from Tunisia, Sudan, Nigeria, Zambia, Botswana, Tanzania and South Africa (Arthur Taute).&nbsp; A Business Plan was also adopted to chart the way forward.&nbsp; SAACE remains the Secretariat for the moment and will be charging for any work done in support of GAMA to the GAMA account.&nbsp;&nbsp; GAMA 2008 will be held in Tunisia towards the end of June and GAMA 2009 will be hosted by South Africa at a date still to be determined.&nbsp; The FIDIC Task Team on GAMA, of which I was a member, tabled its final report and has been adopted by the new GAMA executive.<br /><br /></li></ul>Ciao for now.<br /><br /><strong><em>Graham Pirie&nbsp;<br /><br /></em></strong>

<ul><li>I attended the branch meeting of Gauteng North and South where Dr Iraj Abedian was the main speaker on the 30 May, 2007. The main theme of his talk was about the fact that the tertiary sector of our economy currently&nbsp;the fastest growing sector, has to go through a mind shift and start thinking like a world class competitive tertiary sector. He argued that as a nation we have some how&nbsp;got stuck in the past (not in racial terms but in terms of our economy thinking) and still act as if we are a primary (gold producing) economy. In that regard it was interesting to hear that he believed that our tertiary economy (which includes our industry) will substantially benefit from developments in Africa in the medium to long term. This then provides me with a natural entr&eacute;e into my comments on one of the most important recent Group of Africa Member Association meetings. I attended my first GAMA meeting in 2005 in Uganda and took the time to write a business plan that aimed at rejuvenating the organisation. Subsequently FIDIC became heavily involved and created a task team that also looked at the organisation. In short the changes that were made in Botswana sets members of the IBDS up nicely to develop a network over the medium term that they can used to benefit from the increase in work that Dr Iraj Abedian spoke about. &nbsp;<br /><br /><strong><em>Roelof van Tonder<br /><br /></em></strong></li></ul>

<ul><li><u><strong><em>Construction Regulations<br /><br /></em></strong></u>The technical task team, tasked with amending the Construction Regulations, met again on the 17<sup>th</sup> and 18<sup>th</sup> of May.&nbsp; In this session,&nbsp; issues pertaining to the Designer was tackled.&nbsp; <br /><br />In the current regulations the Designer is required to &quot;carry out sufficient inspections at appropriate times of the construction work involving the design of the relevant structure in order to ensure compliance with the design and a record of those inspections is to be kept on site&quot; (reg. 9(2)(f)).&nbsp; The Designer is also required to &quot;stop any contractor from executing any construction work which is not in accordance with the relevant design&quot;<br /><br />These regulations were regarded to be undesirable, by SAACE members.&nbsp; The following were some of the reasons:<br /><br />1.Designers are not always mandated by the Clients to act as their agents in regard to both the design and the construction phases of a project.<br /><br />2.It would therefore not be possible for the Designer to perform such site inspections as he / she would not have access to the site, nor the authority to stop a contractor.&nbsp;<br /><br />3.The Designer would not be remunerated to perform the site investigations in the above circumstance. <br /><br />4.In some instances, Clients use the Designer&#39;s design drawings at a different location from that which it was designed for, and without the Designer&#39;s knowledge.&nbsp; In these circumstances, the Designer would theoretically still be responsible in terms of the current regulations, even though he / she did not know what the Client was up to - very prejudicial to the Designer.<br /><br />5.The Designer also currently has to <strong><em>ensure </em></strong>compliance with the design.&nbsp; This implies that a Designer would have to warrant compliance.&nbsp; This places a huge burden on the Designer since he / she only performs inspections at certain intervals.<br /></li><li>The SAACE proposal was that a Designer should only be required to take on these tasks when mandated by the Client to do so.&nbsp; If not mandated, then the Client&#39;s appointed agent in that regard should be responsible. &nbsp;It was also proposed that the Designer should only <strong><em>verify</em></strong> compliance with the design by carrying out the necessary inspections.&nbsp; In this regard, refer to the&nbsp;in the advisory note of the week (below) <br /><br />The technical task team accepted the SAACE proposal, however, the legal team of the Department of Labour still need to give their approval.&nbsp; <br /></li><li><u>Advisory note for the week <br /><br /></u><strong>How To Reduce The Consulting Engineer&#39;s Risks And Exposure To Claims (search code 85 / 20)<br /><br /></strong>The advisory notes on the SAACE website cover a wide field of topics, ranging from business practice to risk management.&nbsp; They can be found at <a href="http://www.saace.co.za/">http://www.saace.co.za/</a>&nbsp; Click on advisory notes in the left column, and do a search or view the whole list of topics.<br /><br />Contact Quentin Koen at (011) 463 2022 or email: <a href="mailto:quentinkoen@saace.co.za">quentinkoen@saace.co.za</a></li></ul>
